RECOMMENDED ACTION:
Adopt Resolution No. ff-/$?78 to summarily vacate an alley south of Pine Avenue between Harding Street and the southerly projection of Jefferson Street.
ITEM EXPLANATION:
This is a City initiated request to summarily vacate an alley
right-of-way located on the site of the proposed senior center
south of Pine Avenue and west of Harding Street. This section
of the alley way is a remnant from an old subdivision of land
which was abandoned but not officially erased with the construction of the existing school facilities on the site.
Staff is requesting the vacation in order to clear up the issue prior to the construction of the proposed senior center.
Engineering staff reviewed the right of way which is proposed to be vacated and has determined that it is not needed to serve the senior center or any other adjacent properties. The utility companies have been notified of the vacation and have indicated they do not oppose the vacation.
Since the alley right-of-way does not contain public
improvements and has not been utilized for over five years a
summary vacation process can be used to vacate the right-of-way easement.

' : E$&WA , CALIFORNIA, SUMMARY VACATING AN ALLEY SOUTH PINE AVENUE BETWEEN HARDING STREET AND THE SOUTHERLY PROJECTION OF JEFFERSON STREET

WHEREAS, the above stated alley right-of-way which was
previously dedicated will provide no usable access to the
adjoining properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said alley, more particularly described on Exhibit
ttA1t attached hereto, is excess right-of-way not required for
street purposes.
3. The alley lies entirely within property under one
ownership and that does not continue through such ownership or end
touching property of another; and
4. The alley has not been used for a period of five
consecutive years and no public money has been expended for its
maintenance during that period; and

5. That pursuant to Section 8334 of Article 1 of Chapter 4
of Part 3 of Division 9 of the California Streets and Highways
Code, said alley be summarily vacated.
6. The City Clerk is instructed to record this Resolution
of Vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 215t day of -
