ITEM EXPLANATION
This agenda bill has been prepared at the request of Mayor Lewis and
Mayor Pro Tem Kulchin to address concerns with existing procedures for
council initiated agenda bills which allows matters on the agenda
without administrative or legal review or input from other Council
members. Thus, the Council can be presented with an item without
the 1°full picture" necessary for an informed decision.
The Municipal Code provides that items may be placed on the agenda by
any member of the City Council, the City Manager or the City Attorney.
Procedures require that all agenda items be in the City Manager's
office no later than Friday, 12 days before the scheduled Council
meeting and that they be reviewed by the Finance Director in regard
to funds, by the City Attorney as to form and legality and by the City
Manager as to administration. However, Council initiated items are
exempt from this process.
Attached is Ordinance No. N§� which would revise the procedures for
Council initiated agenda items. The ordinance amends Section
1.20.060(a) by adding a requirement that Council initiated matters be
submitted to the City Manager no later than the Friday, 12 days prior
to the scheduled Council meeting. The City Manager is then required
to immediately circulate copies to the other members of the Council
for comments which must be returned to the City Manager no later than
the Wednesday, seven days prior to the scheduled Council meeting. The
City Manager will then incorporate any comments received in the agenda
bill. When time constraints exist which require a faster schedule the
mayor may approve placing a matter on the agenda as soon as the item
is prepared provided copies shall be sent to the other members of the
City Council, City Manager and City Attorney and, to the extent
possible, any comments received shall be incorporated in the agenda
item. The ordinance also amends Section 1.20.060(b) to subject
Council initiated agenda items to the same legal and administrative
review process as applies to any other agenda matter.

AN ORDINANCE OF THE CITY COUP;CIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 1, CHAPTER 1.20
OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF
SECTION 1.20.060 TO REVISE THE PROCEDURES FOR
COUNCIL ORIGINATED AGENDA ITEMS
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION I: That Title 1, Chapter 1.20, Section 1.20.060 of
the Carlsbad Municipal Code is amended by the amendment of
subsection (a) and (b) to read as follows:
"(a) An agenda shall be prepared for each council meeting
containing the time and place of the meeting, the order of business
and a general description, including the specific action requested
to be taken by the council, for each item of business to be
transacted or discussed at the meeting. Items of business may be
placed on the agenda by the direction of a member of the council,
the city manager or the city attorney. Council originated items
shall be submitted to the city manager by Friday, twelve days prior
to the scheduled council meeting. The city manager shall promptly
give copies to the other members of the city council for their
review and comment. Comments must be returned to the city manager
by Wednesday, seven days prior to the scheduled council meeting.
The city manager shall include any such comments as a part of the
agenda item. If time constraints require it the mayor may approve
expedited processing for a council originated item provided copies
are made available to the other members of the council, the city
attorney and the city manager as soon as the item is prepared and,
to the extent possible, any comments received shall be incorporated.
Agenda items, including ordinances, resolutions, contracts, staff
reports or other matters to be submitted to the council, shall be
delivered to the city clerk not later than five p.m. on the
Wednesday preceding the regular rieeting. The clerk shall thereafter
prepare an agenda packet under the direction of the city manager.
The agenda packet shall be delivered to the council members on the
Friday preceding the regalar meeting. The agenda packet shall be
made available to the public as soon thereafter as practicable.
(b) All agenda items, ordinances, resolutions and contract
documents shall, before presentation to the council, have been
approved as to form and legality by the city attorney or his
authorized representative, and shall have been examined and approved
for administration by the city manager or his authorized
representative, where there are substantive matters of
administration involved.

EFFECTIVE DATE: This ordinance shall be effective thirty'
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in tho Carlsbad Journal within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 28th day of ,Tune _, 1988,
and thereafter
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad on the 5th day of July , 1988, byi
the following vote, to wit:
