PLN /i&My- RECOMMENDED ACTION: Information only - No action required. ITEM EXPLANATION Pacific Rim Master Plan Lagoon property has been conveyed to the public. History On December, 22, 1987 the Carlsbad City Council approved two Local Coastal Program (LCP) Amendments. In addition, the Council conditionally approved the Pacific Rim Master Plan to implement portions of the two amended LCP segments. The City Council through Conditions 24 and 25 of the Master Plan, required Hunt Properties, Inc. (or its successors) to offer to dedicate its lagoon holdings (approximately 387 acres) to the State Lands Commission (SLC). The offer was required to occur within thirty (30) days of the Coastal Commission's approval of the LCP amendments and the Master Plan project. On April 14, 1988 the Coastal Commission approved the City's LCP amendment application, the implementing Master Plan and the first phase of the project. This action set the stage for the lagoon dedication. May 9, 1988 SLC approved a title settlement and exchange agreement conveying the lagoon and adjacent public access easements. Hunt Properties subsequently sold the Pacific Rim Master Plan including the lagoon holdings to Hillman Properties West, Inc. (HPWI). The new owner on June 6, 1988 (within the 30 day Master Plan requirement) executed an agreement transferring its lagoon holdings to SLC. That Agreement was then executed by SLC on June 7th and approved by the Governor on June 9, 1988. The title agreement became effective when it was recorded by the San Diego County Recorder on June 10, 1988. With the acquisition of the Pacific Rim holdings, the State of California now holds title to approximately 600 acres of Batiguitos Lagoon. The City as part of the six party Lagoon Enhancement Agreement (LEA) is currently researching whether any privately owned lagoon sliver parcels remain. Staff will return to Council at a later date with the results of this research.
