During the Public Comment section of the June 7, 1988 Council meeting, Mr. Henry Thompson presented comments regarding staff attendance at the April 14, 1988 Coastal Commission meeting. Attached is a response the Council directed staff to prepare. FISCAL IMPACT: None. EXHIBIT: 0 1. Memorandum to City Manager dated June 24, 1988. 9 6 June 24, 1988 TO: CITY MANAGER FROM: Assistant City Manager CARLSBAD CITY STAFF PARTICIPATION AT THE APRIL i4, 1988 COASTAL COMMISSION HEARINGS Du-ing the public participation section of the June 7, 1988 City Council meeting, Mr. Henry Thompson presented remarks regarding city participation in the subject meeting. City staff was asked to prepare a response to Mr. Thompson's comments. The April Coastal Commission meeting was held in Marina del Rey near Los Angeles International Airport. Commission meetings begin at 9 a.m. and last from one to three days depending on the Commission's workload. The Coastal Commission agenda has administrative permit and consent calendar sections that are usually handled routinely at the beginning of the meeting with one vote of the Commission. The Commission typically quickly passes the administrative and consent calendar and begins hearings on other more complex issues. Applicants before the Commission therefore need to be present and prepared to begin presentations and discussions of their items at 9 a.m. or very soon thereafter. There were six items of concern to the City of Carlsbad on the April 14, 1988 Commission agenda. (A copy of the Coastal Commission agenda is included for your information as Exhibit A.) The City of Carlsbad was the applicant on four of these items. Item 4(g) dealt with an application to build a beach access stairway on Ocean Street. Items 6(b) and 6(c) dealt with the revision of the Local Coastal Programs relating to the Hunt Properties project. Item 7(a) concerned an application by the State Department of Parks and Recreation for a beach parking lot and an administrative and maintenance facility in the City of Carlsbad. Item 7(c) was a coastal development permit application by Hunt Properties, Inc. for development of the Pacific Rim project. Item 7(f) was a coastal development permit for the Palomar Airport Road West Assessment District project. The significant point with these items is that in four of the six items, the City of Carlsbad was the applicant on she item. Therefore, Carlsbad staff would be responsible for making the initial presentation to the Commission and responding to Commission questions. The attached memorandum, dated June 1.5, 1988 from the Planning Director (Exhibit B), outlines the City's role in these four items. In order to adequately present these items and to respond to Commission questions, City staff members and policy makers needed to be present. Seven staff members and two Council Members attended the meeting. In audition, two consultants from Westech Services, the EIR consultants on the HPI project, were also present. These consultants were present at City request but paid for by Hunt Properties, Inc. On item 4(g), two staff members, Municipal Projects Manager John Cahill and Project Manager Al Virgiiio, were present to respond to any questions. June 24, 1988 CITY MANAGER/COASTAL Page 2 Three staff members, Charles Grimm, Assistant Planning Director, Gary Wayne, Senior Planner and Chris DeCerbo, Associate Planner, represented the City on items 6(b) and 6(c). Mayor Lewis and Mayor Pro Tem Kulchin were also present to testify on behalf of the City's application and submittal on these items. For item 7(a), the application by the State Department of Parks and Recreation, two staff members were present, City Engineer Lloyd Hubbs, and Senior Planner Gary Wayne. Mr. Hubbs and Mr. Wayne were present to deal with circulation, access and environmental issues pertaining to this application. On item 7(f), three staff members were present for this item. City Engineer Lloyd Hubbs, Municipal Projects Manager John Cahill and Project Manager Al Virgilio. This $7 million plus Assessment District is a vital element in the City's circulation plan and the securing of a coastal development permit is critical for this project to proceed. In addition to the aforementioned staff and Council Members, City Manager Ray 'Patchett was also present to testify as needed and to provide overall coordination of staff responses to issues. From my review, it is clear that the attendance of Council Members and staff at this hearing was not only appropriate but vital. In the coastal zone, final approval for projects, public and private is granted by the Coastal Commission. Objective, clear, well -coordinated presentations are important in order to allow the Coastal Commission to make sound decisions on projects put before it. In light of the number and complexity of the projects concerning Carlsbad on this Coastal Commission agenda, it should be expected that significant staff participation would be required to adequately represent the City's positic(, on a variety of items. In Mr. Thompson's presentation, he requested information regarding the total amount of City's funds for expenses. An audit of the travel expenses submitted by the attendees at the hearing totals $609.19. Expenses such as the cost of using of City vehicles and employee salaries, were not calculated. Three staff members, Messrs. Grimm, Wayne and DeCerbo, traveled to Marina del Rey on the afternoon of April 13, 1988 and spent the night in a hotel. It was felt essential that these staff members be at the Commission meeting at 9 a.m. since the items they were principally involved with, items 6(b) and 6(c) would come up relatively early on the agenda. These were very complex items and they needed to be adequately prepared and set up to make presentations. These three staff members drove a City vehicle in order to carry the required exhibits for their presentation. Mayor Lewis, Mayor Pro Tem Kulchin and City Manager Patchett flew from San Diego to Los Angeles Airport. City Engineer Lloyd Hubbs, Municipal Projects Manager John Cahill and Project Manager Al Virgilio drove a City vehicle June 24, 1988 CITY MANAGER/COASTAL Page 3 to Marina del Rey. They left at approximately at 5 a.m. in the morning in order to be to reach the Commission meeting by its 9 a.m. start time. Total expenses for travel to the Commission meeting are outlined in Exhibit C. It appears that all travel was appropriately authorized, and that expenses were reasonable and consistent with the City's travel policy. I recommend that this memo be filed with the City Council and no further action is necessary. On April 14, 1988 City staff from the Engineering and Planning Department did participate in presenting the City's position regarding several items scheduled for the Coastal Commission hearings held at Marina Del Rey, California. Carlsbad was the applicant for the following items scheduled that day: 1. Coastal Permit No. 6-99-104, to rebuild concrete beach access staircase at 2701 Ocean Street. 2. Coastal Permit No. 6-88-40, to widen 7,900 feet of Palomar Airport Road east of Paseo del Norte. 3. Submittal of a new Local Coastal Program (LCP) Segment for East Batiquitos Lagoon/Hunt Properties. 4. Amendment proposal to the Mello I LCP to provide consistency between the LCP and the City's General Plan. City participation on items 2, 3 and 4 above was especially necessary since the coastal staff was recommending both denial of the City's LCP submittals (items 3 and 4) and significant modifications to the roadwidsning project which would have rendered the project infeasible. At the hearings the City was able to convince the Commission to support all of Carlsbad's concerns and thereby reject the coastal staff's recommendations. In addition to the City sponsored projects on the April 14th agenda there were two projects of significance to Carlsbad. Coastal Permit No. 6-87-680 was a request by Hunt Properties, Inc. to permit the Pacific Rim Resort. The City was supporting the applicant because coastal staff was recommending modifications that were inconsistent with Carlsbad approvals. The other items of Carlsbad interest was Coastal Permit No. 6-87-667. The City was supporting the applicant's (California Department of Parks and Recreation) appeal of a coastal staff recommended condition. The condition required a redesign of the entrance to the proposed Ponto Beach parking and day -use facilities. Carlsbad contended that the recommended redesign would have a negative impact on traffic safety in the area. JUNE 15, 1988 FRANK MANNEN PAGE 2 The Coastal Commission, in approving the two permits, rejected its staff's recommendations with regard to Carlsbad's concerns. The Carlsbad representatives were well prepared and did a very good job of presenting the City's position to the Coastal Commission, This is evidences by the City's success at that April 14th hearing. Briefly the facts were; 1. The master plan for the development had already been approved by the Carlsbad City Counal. No further section by the City Was neaeasa-.y. 2. An ameadment to the Local Coastal Flan was nought in order to inoreaee the residential density of Phase I including environmental sensitive land all along the north shore of Bati.quitos Lagoon, The City ' s position had been previously conveyed to the Coastal Commission. No further action on the City's part was necessary. 3. If a Coastal Commission Permit could be obtained, Hunt Properties Project would greatly increase in value. There appears to have been no c-ompelling City interest in appearing before the Coastal Commi.ssioa except to aid Hunt Properties 4. However Council. Members Lewis and Kuldbin, four City employees and a City consultant appeared at the Coastal: Commisaion hearing. Pive City representatives offered eommenta in support of the Hunt Properties P'ro jea.t. Councilman Lewis stated that there was no opposition in Carlsbad to the pro; ect as planned. However 'three private citizens were at the hearing and objected to certain aspects of the development which are believed to endanger Batiquitos Lagoon and surrounding senal-tive wildlife habitat. Additionally petition letters signed by 509 residents expresalng the sane eonceras were presented to the Coastal Commission.. 5. Now we arrive at the crux of the matter. It appears that the only purpose of the junket to Los Angeles by two Carlsbad Council - persons., four City employees and a City consultant Was to help Hunt Properties obtain. a Coastal Commission permit, Question',were the amounts spent for travel, meale, loa3ing (if any), and the salaries of the City employees legitimate City expenses? E. It appears to me that this was not a proper expenditure of City funds.
