SH SETBACK STANDARDS
RECOMMENDED ACTION:
Both the Planning Commission and staff are recommending the City Council APPROVE the Negative Declaration is qed b Planning Director and introduce Ordinance No. 25-a 4 APPROVING ZCA 88-3.
ITEM EXPLANATION
During recent review of the Solamar Mobilehome Park pe
staff found a number of inconsistencies between the stan
of Title 25 Chapter 2 of the California Administrative
(Mobilehome Park Act) and the Residential Mobilehome
a (RMHP) Zone. Basically, the development standards of the
Zone do not address setbacks for garages, carports, or st
a cabinets. These standards are addressed in Title 25 as a
of promoting health and fire safety. Staff is recomme modifications to the RMHP Zone which would provide, in
areas, a minimum conformance to Title 25.
The proposed amendment addresses the following three chanc

The Planning Director has determined that this project wi cause any significant impacts and, therefore, has iss Negative Declaration on February 19, 1988. In addition, no comments were re during the public notice period for the Negative Declar The Planning Commission agreed with the Planning Dire

21.37, SECTION 21.37.100, OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION
21.37.100(7) TO ESTABLISH SETBACK STANDARDS FOR GARAGES, CARPORTS, AND STORAGE CABINETS IN THE RMHP ZONE.

SECTION 1: That Title 21, Chapter 21.37, of the C
Municipal Code is amended by the amendment of
21.37.100(7) to read as follows:
21.37.100(7) - Except for corner lots, each mol: lot shall have a side yard of not less than three fee

update the provisions of Chapter 21.47 regarding

PUBLIC HEARINGS:
2) ZCA 88-3 MOBILE HOME PARK AMENDMENT - A Zone Code Amendment establishing setback standards for garages,
carports, and storage cabinets in the Residential Mobile
Home Park Zones (RMHP).
Gary Wayne, Senior Planner, noted that several modifications
to the proposed ordinance have been passed out and would be
discussed in his staff report.
Gary Wayne proceeded with his staff report and reviewed the
background of the request. amendment was City-sponsored and necessary to establish
requirements for garages , carportslawnings, and storage
facilities in the residential mobile home park zone. He
cited the recent review of the Solamar Mobilehome Park permit
when staff uncovered many inconsistencies between Title 25
(Mobilehome Park Act) and the Residential Mobilehome Park
(RMHP) Zone.

amendment covers five items: (1) establishes a 3 ft. side
and setback for private garages;
awnings to be made of noncombustible materials and installed
no less than 3 ft. from another structure; (3) allows for small storage cabinets within a setback if safety standards
are met; (4) defines the difference between storage cabinets
and storage buildings; and (5) cross references Section 2148
of the zoning code which deals with limiting expansion of
nonconforming structures by reason of open space and side
yards. The proposed amendment is consistent with the stated
intent of the General Plan regarding public health, safety,
and welfare by providing setbacks which promote fire safety. Staff recommends approval.
Commissioner Schramm noted that the staff report cited
carports of combustible materials and inquired about carports
of noncombustible materials.
Title 25 allows combustible carports with setbacks, the same
as garages, but staff has treated carports and awnings alike due to their similarities. Commissioner Schramm would like

111. DISCUSSION OF ENVIRONMENTAL EVALUATION
The purpose of the proposed zone code amendment is to establish
several additional setback requirements for mobile home parks.
These areas were overlooked when the Residential Mobile Home
Park Zone was adopted. The proposed requirements will establish consistency with Chapter 2, Title 25 of the California
Administrative Code as a means of promoting health and fire safety. Similar restrictions are found in all other sections of
the zoning ordinance.
These setback requirements relate to the issuance of ministerial
forms of permits which are exempt under CEQA. There will be no
significant effects on the environment because there will be no
change to the physical conditions within the area including
land, air, water, minerals, flora, fauna, noise, or objects of
historic or aesthetic significance. Therefore, a negative declaration is the appropriate environmental assessment.
