N 0712D MTQ. 88 ESTABLISH PRIMA FACIE SPEED LIMIT CITY A.l-Vf=A DEPT.s_ ON'A PORTION OF TA'riARACif AVENUE CITY MQI RECOMMENDED ACTION: Introduce Ordinance No._ tr—��o establish a prima facie 45 milli per hour speed limit on Tamarack Avenue, from El Camino Real to Elm Avenue and to establish a prima facie 35 mile per hour speed limit on Tamarack Avenue, from Elm Avenue to Harwich Drive. ITEM EXPLANATION: The City of Carlsbad Police Department requested that a prima facie speed limit be established on the referenced portions of Tamarack Avenue. At the June 6, 1988 Traffic Safety Commission (TSC) meeting, staff presented the results of a traffic and engineering survey as required by the California Vehicle Code. Based upon the results of the survey, the Traffic Safety Coordinating Committee recommended to the TSC that Tamarack Avenue be divided into two (2) speed zones. The Traffic Safety Commission concurred and recommended by a 3-0 vote that a 45 mile per hour prima facie speed limit be established from E1 Camino Real to Elm Avenue and that a 35 mile per hour prima facie speed limit be established from Elm Avenue to Harwich Drive. NS-25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.300 TO ESTABLISH THE SPEED LIMIT ON TAMARACK AVENUE FROM EL CAMINO REAL TO HARWICH DRIVE. The City Council of the City of Carlsbad, California, hereby ordains as follows: Section 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by the addition of Section 10.44.300 to read as follows: "10.44.300 Tamarack Avenue: (a) Upon Tamarack Avenue from E1 Camino Real to its intersection with Elm Avenue the prima facie speed limit shall be forty-five miles per hour. (b) Upon Tamarack Avenue from Elm Avenue to its intersection with Harwich Drive the prima facie speed limit shall be thirty-five miles per hour." EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of said City Council held - on the 12th, day of July 1988, and thereafter, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 19th day of -July 1988 by the following vote, to wit: AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson NOES: None ABSENT: None ti tt'A UDE A.
