RECOMMENDED ACTION:
Adopt Resolution No. ff-JJbL approving plans, specifications, and
contract documents, authorizing the City Clerk to advertise for
bids for the construction of improvements to Park Drive including the Park Drive 1911 Act Assessment District and City of Carlsbad intersection improvements to Park and Marina Drives, Project No. 3216, combining project accounts and appropriating project funds .
ITEM EXPLANATION:
The City Council, on May 20, 1986, adopted Resolution No. 8521,
overruling and denying protests and directing the Superintendent of Streets to construct street improvements along Park Drive pursuant to Chapter 27 of the Improvement Act of 1911. A group

improvements, retaining walls, and intersection modifications to Park and Marina. Construction is anticipated to begin in late
September and require approximately ninety (90) days for
completion. The City has previously obtained the necessary
coastal development permit issued by the California Coastal
Commission as well as all other environmental approvals.
Staff recommends approval of the plans, specifications and
contract documents and authorization to advertise construction
bids for this project.

ENVIRONMENTAL REVIEW:
A Notice of Exemption was prepared by the Planning Department for
this project due to the fact the proposed Park Drive project involves minimal widening of an existing street within the City of Carlsbad's circulation system. The proposed improvements are considered exempt on the basis of the determination the project
will construct minimal alteration of the existing physical
features of the site and are considered to be minor in nature,
i.e., approximately six hundred (600) cubic yards of grading are involved to an existing City street. Attached is a copy of the Notice of Exemption.
GENERAL PLAN CONSISTENCY:
The Planning Commission formally adopted Resolution No. 2696 on
October 21, 1987 determining the improvement to Park Drive were
in conformance with the City's General Plan.

The City Council previously appropriated in the 1985-86 Capital
Improvement Program Budget a total of $70,000 for the City's
improvements to the intersection of Park and Marina. Additionally, the City Council previously budgeted $64,000 for the design, construction, and assessment engineering for the assessment district portion of the project. Based upon final design and recent completion of the final right-of-way required for the project, the total estimated project costs have increased as indicated above.
Staff recommends the City Council appropriate the following funds to accomplish the construction of this project:
1. Appropriate $165,594 from the City's General Capital
Construction Fund as the CityIs cost for the improvements.
2. Appropriate $48,600 from the CityIs General Capital
Construction Fund representing necessary cash flow for the
assessment district portion of the project subject to later
receipt of assessment district bond proceeds which will be
thereafter reimbursed to the General Capital Construction
Fund.
3. Staff recommends merging the previously separate job numbers
and project accounting for the assessment district portion
of the project (Project No. 3192) into the City's budgeted improvements (Project No. 3216) for budgetary, construction administration, and project accounting efficiency. All
assessment district related costs will be separated and
identified at the conclusion of the project for the
purposes of determining the final assessment spread.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING
THE CITY CLERK TO ADVERTISE FOR BIDS, AUTHORIZING THE
APPROPRIATION OF FUNDS FOR THE IMPROVEMENTS TO PARK DRIVE,
PROJECT NO. 3192, AND IMPROVEMENTS TO THE INTERSECTION OF
PARK AND MARINA DRIVES, PROJECT NO 3216.
WHEREAS, the City Council of the City of Carlsbad has
determined it is necessary and in the public interest to
construct both the improvements to Park Drive, Project No.
3192, and the intersection improvements to Park and Marina
Drives, Project No. 3216; and
WHEREAS, plans and specifications for the furnishing of all
labor, materials, tools, equipment, transportation, and other
expenses necessary or incidental for said projects have been
prepared and are on file in the Municipal Projects Department of
the City of Carlsbad and are incorporated by reference herein;
and
WHEREAS, the City Council of the City of Carlsbad pursuant
to the provisions of Chapter 27 of the Improvement Act of 1911,
have determined it necessary and in the public interest to
proceed to construct certain improvements as a portion of this
project ;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the plans and specifications as presented are
hereby approved.

3. That the City Clerk of the City of Carlsbad,
California, is hereby authorized and directed to proceed to
publish, in accordance with law, Notice to Contractors inviting
bids for the construction of the improvements to Park Drive and
the intersection improvements to Park and Marina Drives in
accordance with the plans and specifications hereinabove
referred to.
4. That an appropriation in the amount of $213,634 from
the unappropriated balance of the General Capital Construction
Fund to the Park and Marina Drive Improvement project, Account
No. 300-820-1840-3216 is hereby authorized and approved.
5. That the Superintendent of Streets is hereby authorized
and directed to proceed with installation of improvements
pursuant to the provisions of Chapter 27 of the Improvement Act
of 1911 necessitated by this project.
6. That the Director of Finance is hereby authorized to
transfer all previously approved project related appropriations,
expenditures, and encumbrances associated with Project No. 3192
to Account No. 300-820-1840-3216 to enable a merging of these
projects for budgetary and project accounting efficiency.

7. That the City Council of the City of Carlsbad hereby
declares the construction of said project to be necessary,
desirable and in the public interest and direct staff to
proceed in accordance with the intent of this Resolution.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 2nd day of August I
1988 by the following vote, to wit:
