Following a tabulation and a crediting to the contractor of the number of days granted for rain delays and approved project change orders, this project was completed a total of 111 days beyond the contract period. The Page Two of Agenda Bill No. 73’56 contract documents and specifications which govern the terms, conditions and performance schedule for the project assess $750 per calendar day for each day beyond the project completion date. Accordingly, this contractor has been assessed a total of $83,250 of liquidated damages for late completion which has been deleted from the last project progress payment. The contractor was notified in writing on numerous occasions during the course of the project concerning their failure to meet the project’s requirements. Additionally, the level of project administration, coordination and inspection by City forces required for this project far exceeded that required by other, considerably more complex public works construction projects the City has completed in the last few years.
