CONSTRUCTION OF IMPROVEMENTS TO
3ECOMMENDED ACTION:
Adopt Resolution No. ff-2 60 accepting the construction of
improvements to Elm Avenue, east of El Camino Real, Project No.
3230, as complete, directing the City Clerk to record the Notice
of Completion, and authorizing the Director Finance to close the
project account upon final payment of all claims and costs.
ITEM EXPLANATION:
Improvements to Elm Avenue, east of El Camino Real, Project No. 3230, have been satisfactorily completed. These improvements
complete the installation of ultimate street improvements to
secondary arterial standards on Elm Avenue east of El Camino
Real. The improvements included the excavation and removal of
approximately 40,000 cubic yards of dirt and the addition of curb
and gutter, raised median, street lights, sidewalks, asphalt
paving, landscaping, and irrigation systems on the south side of Elm Avenue.
Staff recommends the improvements for this project be formally
accepted.
FISCAL IMPACT:
The City Council has previously appropriated total project funds in the amount of $850,000 for this project. A summary of the
estimated final project costs is as follows:

The contractor for this project, Southland Paving Company, Incorporated, experienced numerous delays during the
construction of this project due entirely to matters under the
sole control of the contractor. Following a tabulation and a
crediting to the contractor of the number of days granted for
rain delays and approved project change orders, this project was
completed a total of 111 days beyond the contract period. The

contract documents and specifications which govern the terms,
conditions and performance schedule for the project assess $750
per calendar day for each day beyond the project completion date. Accordingly, this contractor has been assessed a total of
$83,250 of liquidated damages for late completion which has been
deleted from the last project progress payment. The contractor
was notified in writing on numerous occasions during the course
of the project concerning their failure to meet the project’s requirements. Additionally, the level of project administration, coordination and inspection by City forces required for this
project far exceeded that required by other, considerably more
complex public works construction projects the City has completed
in the last few years.
Staff recommends formal acceptance of the improvements to Elm Avenue east of El Camino Real and the filing of the Notice of
Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ACCEPTING
THE CONSTRUCTION OF STREET IMPROVEMENTS
TO ELM AVENUE EAST OF EL CAMINO REAL,
PROJECT NO. 3230, AS COMPLETE
WHEREAS, the construction of street improvements to Elm
Avenue east of El Camino Real, Project No. 3230, have been
satisfactorily completed: and
WHEREAS, the formal project Notice of Completion has been
prepared: and
WHEREAS, the City Council has previously appropriated
funds for this project:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the street improvements to
Elm Avenue east of El Camino Real, Project No. 3230 are deemed
complete and hereby accepted by the City of Carlsbad.
3. That the City Clerk is hereby authorized to execute
the Notice of Completion and have same recorded.
