C.D* CITY N RECOMMENDED ACTION: C\TY A FOR ZONE 8 - RECOMMENDED ACTION The Planning Commission and staff are recommending that the C Council Adopt Resolution No. ,‘J-AflI denying without prejudice Local Facilities Management Plan for Zone 8. ITEM EXPLANATION On August 18, 1987 the City Council authorized Kaufman and Br of San Diego to prepare the Local Facilities Management Plan Zone 8. Zone 8 is located in the northwest quadrant of the C generally north of Palomar Airport Road and west of El Camino R as shown on the attached Exhibit No. 1. Following the authorization to prepare the plan by the C Council, Kaufman and Broad and their consulting team began worP the Zone Plan. On November 16, 1987 this plan was accepted by City for technical review and the appropriate $10,000 process deposit was submitted with the City. The California Government Code Section 65950 requires t development projects shall be approved or disapproved within months from the time an application has been accepted as bc November of 1987. Section 65957 allows the time limits establiE by the previous government code section to be extended once fc period not to exceed 90 days upon the consent of the public agc and the applicant. In April 1988, Kaufman and Broad requested received a 90 day extension to continue the preparation of t Local Facilities Management Plan. However, following t extension of time, the plan has not been completed as required is not in a condition where staff may recommend approval. WHEREAS, a complete applciaton was accepted for the preparation of the Local Facilities Management Plan for Zone 8 on November 16, 1987; and WHEREAS, said verified application constituted a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the applicant in April of 1988 requested and received a 90 day extension for this application; and WHEREAS, the Planning Commission did on July 6, 1988 hold a duly noticed public hearing and recommended that this application be denied without prejudice; and WHEREAS, at a regularly scheduled Council meeting the City Council did on the 2nd day of August 1988, ~ consider said request; and 21 22 23 24 WHEREAS, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council considered all factors relating to the Local Facilities Management Plan for Zone 8.
