RECOMMENDED ACTION:
Direct staff to continue following City Policy on issuing of sewer permits
concurrently with building permits and requiring that a coastal development
permit be obtained prior to issuing a building permit.
ITEM EXPLANATION:
On July 13, 1988, the California Coastal Commission approved a permit that will
allow the Encina Water Pollution Control Facility (EWPCF) to install a third
outfall pump. However, the Commission is requiring EWPCF to comply with a
special condition prior to issuing the permit. The condition calls for the
City of Carlsbad and other member agencies serving the coastal zone to require
a coastal development permit prior to guaranteeing or providing sewer service
to any development. Current City policy meets the requirement as sewer permits
are only issued concurrently with building permits and building permits for
the coastal zone are not issued until after a coastal development permit has
been obtained.
Coastal Commission staff have indicated that Carlsbad will satisfy their
obligation under requirements of the special condition by providing EWPCF with
a letter stating that the above policy has been submitted to Council as an
information item and that staff will continue to follow the policy.

Subject: Coastal Commission Permit for Installation of
Third Outfall Pump at Encina
On July 13, 1988, the California Coastal Commission approved a permit that would
allow Encina to install a third outfall pump. However, the Commission deferred
issuing the permit until Encina complies with Special Condition No. 1 (see
attached copy). Commission staff have indicated verbally that Carlsbad would
be in compliance with Special Condition No. 1 if the City's Planning Director
(1) prepares an information item for the Council agenda, indicating how City
staff will comply with the condition, and (2) send a letter to Encina cer-
tifying that the procedures have been discussed with the Council and will be
followed by staff. Encina would then submit these letters (from Carlsbad, the
Leucadia County Water District, and the Encinitas Sanitary District) to the
Commission.
As you know, Encina needs to move ahead quickly with the installation of the
third outfall pump. Ws plan to have complied with the Commission' s conditions
by August 19, 1988, in order to award a contract on August 25 and ensure tump
installation by July 1, 1989. As Carlsbad's representative on Encina's
Technical Adivsory Committee, your assistance in bringing this matter to the
attention of the proper individuals and expediting its resolution would be
appreciated.

III. Special Conditions.
The permit is subject to the following conditions:
1. Sewer Service/Local Coastal Program Consistency. Prior to the
issuance of the coastal development permit, the applicant shall submit an
acknowledgement from each of the members of the Encina Joint Powers Agency
providing service to areas within the coastal zone that:
Prior to certification of the applicable Local Coastal Programs or
transfer of coastal development permit authority, sewer service shall
neither be guaranteed to nor provided to any development which has not
received all necessary coastal development permits.
After certification of the applicable Local Coastal Programs and the
transfer of coastal development permit authority to the local
jurisdictions, service shall be provided only when 1n conformance with the
certified Local Coastal Program. A development shall be deemed to be in
conformance with the certified LCP if (1) the local government has issued
a coastal development permit and, if appealable, the appeal period to the
Commission has expired or 1f appealed, final action has been taken by the
Coastal Commission to approve the development.
Any member of the Joint Powers Agency affected by this condition shall make
any necessary modifications to the Joint Powers Agreement or operating
procedures to implement this condition. Evidence of such modification and
acceptance of the condition shall be subject to the review and written
approval of the Executive Director.
2. Increase In Flows/NPDES Permit. The increase in average daily
outflows proposed and permitted herein shall not be authorized until such time
as all other required approvals have been obtained. Evidence of such
approvals shall be subject to the review and written approval of the Executive
Director at which time a separate letter of authorization concerning the
increased outflows shall be transmitted to the applicant.
IV. Findings and Declarations.
The Commission finds and declares as follows:
1. Project Description. The applicant proposes to install a third
effluent pump to a pump station now equipped with two similar pumps at the
Encina Water Pollution Control Facility, a wastewater treatment plant in
Carlsbad. The pump station at the Encina plant pumps treated wastewater
through a 7,800 linear-foot ocean outfall pipe where it is discharged and
mixes with ocean waters. The treated wastewater which is discharged via the
