LIB COUNCIL GRANT CI1 RECOMMENDED ACTION: ACCEPTANCE OF CALIFORNIA ARTS Adopt Resolution No. approving a grant from the California Arts Council in the amount of $8,962. ITEM EXPLANATION The Arts Office proposes to continue the one week artist residency program with support from the California Arts Council. Macfarland/Whistler DanceArtcompany is scheduled for a community one-week residency/workshop with one performance from September 19-23, 1988. The Dickens Playei are scheduled for a community residency/workshop and one performance, December 5-9, 1988. Carl Stone is scheduled for a community residency from May 24-26, 1989. The San Diego Symphony is scheduled for one performance on Decernbe 18, 1988 at the Carlsbad Community Cultural Arts Center. FISCAL IMPACT Macfarland/Whistler DanceArtcompany's contract is $3,000, The Dickens Players contract is $5,924, Carl Stone's contract is $3,000 and San Diego Symphony's contract is $10,000, total $21,924. California Arts Council will reimburse the Arts Office $8,962 for the four touring companies. The remainder of funds are budgeted in FY 1988/89 Arts Office budget. EXHIBITS 1. 2. The Contractor does hereby agree to furnish to CAC the follc services (1-4): 1. Under the terms of the CAC-TP to enter into contract fo: engagement(s) listed on Exhibit A - Engagements att hereto as a part of this contract. 2. To abide by the terms and conditions of the FY 88-89To Program Sponsor GuSdellnes. 3. To submit to the Touring Program within 60 days i completion of the engagement of said contract descsiptian of the engagement, including numbei participants, admission charged for each activity, an i and expense report and an evaluation of successe: failures of the engagement on the Presenting Oganiz Report form. Programs, examples of publicity and promc and an invoice for the grant share of the performing gr fee must accompany each evaluation. -. 4. To include in all programs and other published mate related to the CAC-TP A SPECIAL NOTE THAT: “THIS EWGA4 IS SUPPORTED, IN PART, WITH FUNDS PROVIDED BY THE CALI1 ARTS COUNCIL, A STATE AGENCY, AND THE NATIONAL ENDOWME1 THE ARTS, A FEDERAL AGENCY.” 5. Upon submittal of the Evaluation, the Prese Organization Report, programs from the engagement and 2 promotional materials, if available, and an invoice t Touring Program, CAC shall pay Contractor the fee suppc designated for the specified engagement. Total payment for any single engagement will be withhe until submission of all required reports. 6. Notwithstanding any other provision of this agreement contrary, the discharge of any financial obligation ( CAC hereunder shall be deferred by the CAC until suc as it has received during this agreement funds (St Federal) available for this purpose. CAC execution o agreement shall in any case be dependent upon the rece properly executed copies hereof by Contractor. -1- 0 e 7. The Contractor must notify Touring Program of any chan the contract with the performing group or of any sc changes. All such changes shall be subject to the w approval of the CAC. 8. The Nondiscrimination Clause (OCP-I), General Cali Arts Council Requirements, and the MEA Provisior attached hereto and are hereby made a part of agreement. It is the Contractor's responsibility tc and adhere to the requirements of these attachments a Program Access regulations, (Section 504 0. Rehabilitation Act of 1973 and the State of Cali1 Government Code 11135-11139.5). 9. This grant shall not be deemed accepted, valid or bind the part of the State unless approved by the Departme Finance and/or General Services of the State of Calif where their approval is required.
