CA CITY MGR.~ RECOMMENDED ACTION: If Council concurs, your action is to introduce Ordinance No.AIS✓iS- ITEM EXPLANATION Assembly Bill 2915, amending Vehicle Code Section 22660, was signed by the governor on June 1, 1988 and is effective on January 1, 1989 allowing the City to remove, as a public nuisance, abandoned, wrecked, dismantled, or inoperative vehicles from private or public property including highways. Previously, the City did not have the authority to remove such vehicles from highways. FISCAL IMPACT There is no fiscal impact since the City is authorized to recover the costs of administration and removal of abandoned, wrecked, dismantled, or inoperative vehicles under the municipal code as authorized by state law. NS-35 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARf.,SBAD, CALIFORNIA AMENDING TITLE 10, CHAPTER 10.52 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 10.52.130 TO ALLOW FOR THE REMOVAL OF ABANDONED VEHICLES ON HIGHWAYS. The City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That Title 10, Chapter 10.52 of the Carlsbad Municipal Code is amended by the amendment of Section 10.52.130 to read as follows: 11 10.52.130 Unlawful and an infraction to abandon, park, store or leave vehicle in excess of three days. It is unlawful for any person to abandon, park, store, or leave or permit the abandonment, parking, storing or leaving of any licensed or unlicensed vehicle or part thereof, which is in an abandoned, wrecked, dismantled or inoperative condition upon any private property or public property within the city for a period in excess of three days, unless such vehicle or part thereof is completely enclosed within a building in a lawful manner, where it is not plainly visible from the street 07 other public or private property, or unless such vehicle is stored or parked in a lawful manner on a private property in connection with the business of a licensed dismantler, licensed vehicle dealer or a junkyard." SECTION 2: This ordinance shall become operative on January 1, 1989. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
