RECOMMENDED ACTION:
That the City Council refer this item to the Planning Commission for a Public Hearing and recommendation.
ITEM EXPLANATION:
Since the adoption of the Growth Management Ordinance, several inquirie: have been made whether a Master Plan can be processed and approved by tk City without first preparing a Local Facilities Management Plan. The reasons why this has been questioned is that the requirement to do a Ma
Plan is a City requirement in the Planned Community (P-C) Zone and, by itself, it does not give any entitlements to develop property. It is a Master Plan that specifically delineates land use and development stand' for a particular area in the City and provides its operative zoning. Property owners are experiencing difficulty in doing the detailed facil planning required for a LFMP without knowing the land uses for their property.
When this was raised on two previous occasions (Pacific Rim Resort and Scripps Hospital), the City Council determined that a LFMP could be processed concurrently with the required Master Plan. recommended that the Growth Management Ordinance be amended to reflect determination in cases where the underlying, overall amount of developm and its facilities needs will not be increased.
The proposed Ordinance would modify Section 21.90.030(c) by the additio Subsection (13) and is attached. The amendment would allow a Master P1 which does not increase the overall residential density or intensity of use or increase facility needs to be processed without first having an approved LFMP as long as the LFMP is processed concurrently with the M: Plan. This will allow the City to ensure that compliance with the pub1 facilities standards of the Growth Management Ordinance are made an intricate part of the Master Plan process.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.90, SECTION
21.90.030(c) BY THE ADDITION OF SUBSECTION (13) TO PROVIDE FOR CONCURRENT PROCESSING OF CERTAIN MASTER PLANS
The City Council hereby ordains as follows:
SECTION 1: Title 21, Chapter 21.90, Section 21.90.030(c) is amend
the addition of Subsection (13) to read as follows:
(13) Master Plans or General Plan Amendments in connection with M
Plans which do not increase the residential density or the overall deve
intensity or facility needs established by the existing General Plan pr

EFFECTIVE DATE: This ordinance shall be effective thirty days af-
