RECOMMENDED ACTION:
Adopt Resolution N0.88~3 57 determining unpaid assessments in a spc assessment district.
ITEM EXPLANATION:
Council confirmed the Palomar Airport Road Assessment District on July 5, 1 Property owners were given 30 days to pay all or part of their assessment or a right-of-way credit in lieu of payment for right-of-way.
As shown on the Paid-Unpaid List (Exhibit l), one property owner paid assessment in full and one owner received a right-of-way credit. The balancc been assessed against the properties for which bonds will be issued.
FISCAL IMPACT:
The two property owners who made a payments or took a credit saved intc payments and have no lien on their property as a result of the district. balance of assessments in the amount of $5,133,940.30 is the amount of bonc be sold and becomes a lien on the affected properties.

RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, DETERMINING UNPAID
ASSESSMENTS IN A SPECIAL ASSESSMENT DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD
CALIFORNIA, has heretofore undertaken proceedings pursuant to th
"Municipal Improvement Act of 1913", being Division 12 of th
Streets and Highways Code of the State of California, and ha
confirmed assessments upon lands within a special assessmen
district described in a Resolution of Intention previous1
adopted for said improvements, said special assessment Distric
known and designated as ASSESSMENT DISTRICT NO. 86-1 (PALOMA
AIRPORT ROAD) (hereinafter referred to as the "Assessmen
District"); and,
WHEREAS, said proceedings provided for the issuance of bond
pursuant to the "Improvement Bond Act of 1915", being Division 1
of the Streets and Highways Code of the State of California, an
it is necessary to establish the unpaid amount of assessments fo
the purpose of issuing bonds; and,
WHEREAS, notice of the recordation of the assessment and o
the time within which assessments may be paid in cash has bee
duly published and mailed in the manner provided by law, and th
time so provided for receiving payment of assessments in cash ha
expired, and there has been filed a list of all assessments whic
now remain unpaid; and,
WHEREAS, said complete list represents all payments receive
on unpaid assessments, as well as any applied credits or appor
tionments as may be necessary to correctly reflect the unpai
balance of assessments.

NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. Recitals. That the above recitals are all truc
and correct.
SECTION 2. Unpaid Assessments. That the assessments noln
remaining unpaid, and the aggregate thereof, are as shown on i
list entitled "Paid and Unpaid Assessments", referenced by the
name of this Assessment District, a copy of which is on file ir
the Office of the Treasurer and by reference made a part hereof.
SECTION 3. Parcel Descriptions. That for a particulal
description of the lots or parcels of land bearing the respective
assessment numbers set forth in said Unpaid List and upon whick
assessments remain unpaid, reference is hereby made to the assess-
ment and to the diagram recorded in the Office of the Superinten-
dent of Streets.
SECTION 4. Issuance of Bonds. The Unpaid List is in thc
amount of $5,133,940.30 , and bonds shall be issued ir
said amount and upon the security of said unpaid assessments ir
accordance with the provisions of the "Improvement Bond Act ol
1915", and under and pursuant to the provisions of said Resolu-
tion of Intention and Resolution Authorizing the Issuance ol
Bonds and Approving Bond Indenture, and all other proceeding5
thereunder duly had and taken.
SECTION 5. Maturity. The bonds shall be issued in seria:
form with annual maturities on September 2nd of every yea]
succeeding twelve (12) months from their date, until the whole i!
paid. The amount maturing each year shall be such as to resull
in approximately equal annual debt service during the term of thc
issue.

SECTION 6. Terms and Conditions of Bonds. For all othe
particulars relating to the terms and conditions of said bonds
reference is hereby made to the previously adopted Resolutio
Authorizing and Providing for the Issuance of Bonds, a copy o
which is on file with the transcript of these proceedings, an
open to public inspection.
SECTION 7. Collection of Assessments. The County Auditor
which is the political subdivision of the State of Californi
which collects taxes for this City, is hereby authorized an
directed, in accordance with the provisions of Section 8682 o
the Streets and Highways Code of the State of California, t
enter into his assessment roll on which property taxes will nex
become due, opposite each lot or parcel of land affected, in
space marked "public improvement assessment'' or by other suitabl
designation, the next and several installments of such assessmen
coming due during the ensuing fiscal year covered by the assess
ment roll and that said entry then shall be made each year durin
the life of the bonds for the proceedings for this Assessmen
District. This authorization is continual until all assessmen
obligations have been discharged and the bonds terminated.
SECTION 8. Separation of Parcels. In accordance with th
provisions of Section 8685 of the Streets and Highways Code, i
any lot or parcel of land affected by any assessment is no
separately assessed on the tax roll so that the installment c
the assessment to be collected can be conveniently entere
thereon, then the Auditor shall enter on the roll a descriptic
of the lot or parcel affected, with the name of the owners, i

known, but otherwise the owners may be described as "unknow
owners", and extend the proper installment opposite the same.
PASSED, APPROVED AND ADOPTED by the City Council of the Cit
day o of Carlsbad at its regular meeting held on the 4th
October , 1988, by the following vote, to wit:
AYES: Council Members Lewis, Mamaux and Pettine
NOES: None
ABSENT: Council Member Kulchin
