TITLE: APPROVAL OF SPECIFICATIONS AND
AUTHORIZATION TO BID RESTORATION
WORK ON ISLANDS IN THE BUENA
VISTA LAGOON, PROJECT NO. 3258

RECOMMENDED ACTION:
Adopt Resolution No.approving the specifications and
contract documents, authorizing the City Clerk to advertise for
bids for restoration work on islands in the Buena Vista Lagoon,
and appropriating project funds.
ITEM EXPLANATION:
The Buena Vista Lagoon is owned and administered as an ecological
reserve by the State of California, Department of Fish and Game.
State Fish and Game dredged the lagoon in 1983 and used the
dredged material to create four (4) small islands for use as sea
bird nesting sites. The islands' surfaces subsequently proved,
over time, to be unsuitable bird nesting areas.
On April 28, 1987, the City Council approved a Joint Powers
Agreement with the State of California, Department of Fish and
Game to restore the two (2) largest islands. The Agreement
identifies State Fish and Game as the responsibility party to
obtain all project permits and provide technical and biological
data for the scope of work. The City will administer all bidding
and construction activities utilizing $94,000 of State funds.
The Department of Fish and Game wildlife biologists have designed
a three (3) step process to restore the two (2) largest and most
barren islands as productive bird habitats:
1. Transplanting of selected vegetation.
2. Regrading and compaction of the islands' surface areas.
3. Placement of a sand topping.
Step 1 was completed this past summer by State Fish and Game
personnel. Based upon their biological survey, Fish and Game has
provided City staff with detailed instructions for the design of
the restoration work. Steps 2 and 3 will be completed by a City
administered construction contract. Grading is necessary to fill
existing craters and fissures on the islands and produce a
smooth nesting surface. It is also the opinion of State Fish and
Game wildlife biologists that capping the islands with sand
enhances the islands as nesting sites for the California Least
Tern, an endangered species.
State Fish and Game is currently in the process of obtaining an
amendment to their existing California Coastal Commission permit
for this project to allow this work to be performed prior to the
commencement of the approximately April 1st nesting season.

Construction is anticipated to occur in December, 1988. In the
unlikely event the California Coastal Commission denies the
permit amendment, all bids for this project will be rejected
thereafter and readvertised next Spring.
ENVIRONMENTAL REVIEW AND CARLSBAD GENERAL PLAN CONSISTENCY
The State of California, Department of Fish and Game has
completed an environmental review for the project and has
determined there will be no significant adverse environmental
impacts resulting from the construction of this project. The
California Costal Commission has issued a Coastal Development
Permit to State Fish and Game for the restoration work.
It is the position of the Planning Director that no General Plan
consistency finding is necessary for this project since the scope
does not include construction of structures or changes in land
use or ownership. No City funds will be expended for this
project.
Staff recommends approval of the project specifications and
requests authorization to advertise for bids for the
construction.
FISCAL IMPACT:
The City has previously received $94,000 from the State of
California, Department of Fish and Game. The account balance is
currently $101,894 including accumulated interest. An
additional $22,248 is available from unused State of California,
Department of Fish and Game funds from the 1983 dredging project
which has remained on deposit with the City. No City
augmentation of the State funding will be required. Staff
recommends that both State funding sources be combined and
appropriated for this project which is provided for in the
existing City/State Agreement. The estimated project cost prior
to receipt of bids is as follows:
Construction $ 95,000

It is recommended to appropriate project funds in the amount of
$101,589 to account number 180-820-8125-3258 and $22,248 to
account number 180-820-8107-3258.

6 WHEREAS, the City Council of the City of Carlsbad,
7 California, has determined it necessary and in the public
8 interest to construct for restoration work on the Buena Vista
9 Lagoon islands; and
10 WHEREAS, the California Department of Fish and Game, in
11 its role as trustee for the Buena Vista Lagoon Ecological
12 Preserve, has developed and approved an island restoration plan;
13 and
14 WHEREAS, the City of Carlsbad, as the local government
15 jurisdiction, has the resources to administer and direct the
16 island restoration work; and
17 WHEREAS, the City of Carlsbad has received funding from
18 the State for the restoration work; and
19 WHEREAS, specifications for the furnishing of all labor,
20 materials, tools, equipment, transportation and other expenses
21 necessary or incidental for said project, have been prepared and
22 are on file in the Municipal Projects Department of the City of
23 Carlsbad and are incorporated by reference herein.
24 NOW, THEREFORE BE IT RESOLVED, by the City Council of the
25 City of Carlsbad, California as follows:

3 3. That the City Clerk of the City of Carlsbad is hereby
4 authorized and directed to publish, in accordance with law,
5 Notice to Contractors inviting bids for the Buena Vista Lagoon
6 islands restoration.
7 4. That the City Council hereby appropriates $101,589 to
8 project account no. 180-820-8125-3258 and $22,248 to project
9 account no. 180-820-8107-3258 from the State grant funds on
10 account with the City.
11 PASSED, APPROVED AND ADOPTED at a regular meeting of the
12 Carlsbad City Council held the 25th day of October
