RECOMMENDED ACTION:
Adopt Resolution No.8%4Y0q accepting a Grant Deed for waterline easeu purposes.
ITEM EXPLANATION:
As a condition of approval of Planned Industrial Permit 86-06 the develc was required to dedicate an easement for waterline purposes across porti of the project site. Opus Southwest, owner of project, has executed attached grant deed and is offering it for Council acceptance. Staff reviewed the easement and finds it acceptable for the intended purpose.
FISCAL IMPACT:
Requiring dedications as a condition of development will save the City expe in future easement acquisitions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED.
WHEREAS, Opus Southwest Corporation has submitted a Grant Deed c(
an easement to the City of Carlsbad for waterline purposes over a poi
Lots 13 and 14 of Map 11287; and

WHEREAS, the City Council of the City of Carlsbad has determined
in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C
California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed from Opus Southwest Corporation, dated
1988, conveying an easement for waterline purposes over a portion of Lot
14 of Map 11287 to the City of Carlsbad which is on file with the City C
is incorporated herein by reference, is accepted.
3. That the City Clerk is authorized to cause the original Dec

CERTIFICATION FOR ACCEPTANCE OF DEED
This is to certify that the interest in real property
conveyed by the deed or grant dated July 28, 1988
from Opus Southwest Corporation
to the City of Carlsbad, California, a municipal corporation,
is hereby accepted by the City Council of the City of Carlsbad,
California pursuant to resolution No. 88-409 , adopted
on November 22, 1988 , and the grantee consents to the
recordation thereof by its duly authorized officer.
