FIN ---- c1~v OF CARLSBAD -AGENr \ BILL REFUND OF OVERPAYMENT BY TAMARACK POINT VENTURE RECOMMENDED ACTION: ~~, ® DEPT.~ CITYA~ fCITYMG~- Council approved a refund for an overpayment of fees made by Tamarack Point Venture. ITEM EXPLANATION: Tamarack Point Venture (TPV) paid for nine building permits, including fees, in 1986. The permits subsequently expired. In 1988, TPV again paid for permits and paid fees a second time on the same parcels. TPV has requested a refund for the original development fees paid as follows: Strong Motion Fees Public Facility Fees Traffic Impact Fees Sewer Fees Park Development Fees Public Facilities Fees Municipal Facilities Fees Total $ 199.70 71,338.00 19,200.00 40,000.00 20,960.00 28,536.04 $ 22,260.00 $202,493.74 TPV has not requested a refund of building permit fees (which is General Fund revenue) because building permit fees are not refundable if the permit has expired. Staff has reviewed the request and concurs that the refund should be made. FISCAL IMPACT: Any refund of fees reduces the amount of revenue available to the city: however, the city may not retain fees collected in error, collected for services which cannot be rendered, or collected with the intention of using said fees for a deposit to guarantee the completion of a task once the task is completed.
