APPEAL OF PLANNING COMMISSION'S DENIAL DEP' RECOMMENDED ACTION: The Planning Commission and staff are recommending that the City Counc the Planning Commission's Denial without prejudice of SDP 88-5. ITEM EXPLANATION On November 16, 1988 the Planning Commission voted 6-0 to deny a Site De Plan (SDP 88-5) to create a four-unit apartment located along the nort Hemlock Avenue between Garfield and (future) Washington Streets. Sta of the project indicated that it complied with the General Plan, standards, and the requirements of Growth Management. Staff, however, re denial of the project as designed because it did not conform to a1 standards of the Beach Area Overlay Zone (BAOZ) with respect to buildi and architectural design. The Beach Area Overlay Zone stipulates that ''no building shall exceed tk or 25 feet in height, whichever is less". The project as proposed is i height; however, within that 25 feet is included three separate levels ( one level partially below grade and two levels above grade). Thi applicant contends that the proposed structure is only two stories tal the lower level does not qualify as a "story" as defined in Title interpretation, which is one of the reasons stated for the appeal, is t the fact that the finished floor above this lower level is not more thai above grade and therefore doesn't qualify as a ''story". However, the Commission and staff contend that this interpretation, while technicall! Overlay Zone in that structural height within the Beach Area relates nc visual aesthetics but also to permitted intensity of development. Specifically; (1) 64 feet of the southerly elevations consist of garage doors, comprising 51% of the 124.5 foot street frontage, and (2) the front yards of the proposed dwelling units are comprised of a dominance of hardscape (71% of the front yard setback area is in hardscape). The Planning Commission voted to deny the project without prejudice in order to allow the applicant to redesign the project consistent with the requirements of the Beach Area Overlay Zone. A straight denial would have required the applicant to wait one year before submitting a redesign. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on September 26, 1988. The environmental analysis, along with the field checks by staff identified that the project site is already graded and developed with two older single family residences. Because there (1) are no sensitive environmental resources located upon or near this already developed site, and (2) because the proposed project is permitted per the existing zoning, no project environmental impacts are anticipated. There were no public comments received in response to the notice for a Negative Declaration. The Planning Commission agreed with the Planning Director’s determination and adopted Resolution No. 2788 approving the Negative Declaration. FISCAL IMPACT Upholding the denial of the project would postpone redevelopment of the site which would postpone the City’s receipt of building and related development fees. RECOMMENDAT ION It is recommended that the Planning Commission ADOPT Planning Commis Resolution No. 2788 APPROVING the Negative Declaration issued by the Plan Director and Planning Commission Resolution No. 2789 DENYING SDP 88-5, bas€ the findings contained therein,. 11. PROJECT DESCRIPTION The applicant is requesting approval of a Site Development Plan to devel four-unit apartment project, located as described above. The subject pro1 is located within the Beach Area Overlay Zone, which requires that a Development Plan be processed for all new residences, excluding single far proposed within this zone. The project site is located in the R-3 Zone and has a General Plan design; of RH (15-23 du/acre) and a Growth Control Point of 19 du/acre. The pro1 project would be located on a .31 acre site (two lots) and have a density of du/acre. The property is cuicrently developed with two older single fi dwelling units. It is surrounded on all sides by single family residence: is located within a neighborhood which is developed predominately with ( single fami 1 y residences . The proposed apartment project consists of two, two-story (three level) dl structures (total of four units). Each of the dwelling units will be i square feet in area. A total of 10 onsite parking spaces will be prov ,including two garage spaces per unit and two open guest parking spaces. DISCUSSION Although the proposed project complies with the minimum standards of tt Zone, it does not comply with all of the development standards of the Beac Overlay Zone. Those issues of concern with regard to the project includ building height, and (2) overall site and architectural design, as dis bel ow: 1. The Beach Area Over1 ay Zone stipul ates that "no building shall exce stories or 25 feet in height, whichever is less". As shown on Exhibi the project as proposed is 25 feet in height; however, within that 2 is included three separate levels (including one level partially grade and two levels above grade). This interprc is based upon the fact that the finished floor above this lower le not more than six feet above grade and therefore doesn't qualif, "story". However, staff contends that this interpretation, technically correct, is in conflict with the intent of the building the Beach Area relates inot only to visual aesthetics but also to per intensity of development. Gar]; Wayne, Senior Planner, reviewed the background of the ‘request and stated that the applicant is requesting approval of a site development plan to develop a four-unit apartment project along the north side of Hemlock Avenue between Garfield and k’ashington, however Washington does not exist as a through street at this time. The area is in the Beach Overlay Zone, LFYP $1, and the Coastal Zone. The proposed project is in compliance with the provisions and conditions of LFMP ,I1 and also the Coastal Plan. However. the prinary issues which staff focused on in its review were the development standards of the Beach Overlay Zone. There are two main issues which were considered. This project consists of two duplex units which forms a four-unit structure. The total structure is three levels high with the garage on the PLANNING COMMISSION Page *O November 16, 1988 grade level, the living area below grade, and the sleeping area on the third level. Staff's interpretation of the Beach Overlay Zone is that structures can only be 25 ft. or two stories, whichever is less; covered parking is counted as a story and shall be included in determining building height. Living areas are also counted as a story. khen the Beach Overlay study was done, the height issue did not focus solely on height and views but also intensity of use. Staff has determined that this project, although only 25 ft. from grade level to the rooftop, is three stories and higher than what is allowed in the Beach Overlay Zone. The second issue is that staff feels that the proposed project does not adhere to the design standards in the beach area because it is too boxy and massive. Staff recommends denial. Chairman McFadden opened the public testimony and issued the invitation to speak. Gary Cohn, 2110 Glasgow, Cardiff, representing the applicant, addressed the Commission and stated that he disagrees with the staff's recomnendation for denial. having some of the living area below grade that it allows for pointed out that the setbacks for this project ar'e greater than the requirenent and that the below grade portion of the building is below grade only in the rear. which is not seen from the street. Mr. Cohn noted that the North Beach Studv did not become available until two month9 after this project was submitted. iie feels that this project complies with the majority of requirements and requested consideration by the Commission. Albert E. Blasic, 260 Hemlock, Carlsbad, addressed the Commission and stated that he owns property next door to the proposed project. He noted that all homes in the area are now single family and he is opposed to a multi-family structure primarily because of che traffic problems in the area at the present time. There being no other persons desiring to address the Commission on this topic, Chairman McFadden declared the public testimony closed and opened the item for discussion among the Commission members. He feels that bv a smaller footprint and. hence, a less massive structure. He Commissioner Schlehuber cannot support the project because he does not feel that it complies with the requirements of the Beach Overlay Zone. Commissioner Hall has looked at a lot of projects in this area and feels that this project has merit; however, it does not meet all of the design standards. He believes that the applicant is on the right track and would like to see the application denied without prejudice so that it can be returned in the near future.
