ITEM EXPLANATION:
The City of Carlsbad Growth Management Plan requires that the per standard for circulation be met at all times as growth occurs. The states that "No road segment or intersection in the Zone nor any Cib Element road segment or intersection out of the Zone which is iml development in the Zone shall be projected to exceed a Service Level off-peak hours, nor Service Level D during peak hours. Impacted i by 20 percent or more of the traffic generated by the Local F Management Zone using the road segment or intersection."
On June 27, 1988 Engineering Department staff received written tech cost proposals from five consulting traffic engineering firms from a nine Request for Proposals that were solicited. An evaluatiot submittals was conducted by a panel consisting of David Hauser, Assis Engineer, Phil Carter, Growth Management Manager and Robert Johnson, Civil Engineer. The firm of JHK & Associates was selected as being qualified firm to conduct the work required by the project.
The consultant agreement will result in the collection of traffic c intersections and 16 road segments twice during 1989. In addition, service calculations will be performed by the consultant to eva performance of the intersection or road segment in context of t Management Plan. THIS AGREEMENT, made and entered into as of the d

NOW, THEREFORE, in consideration of these recitals and mutual cove

1. CONSULTANT'S OBLIGATIONS

4. FEES TO BE PAID TO CONSULTANT

5. PAYMENT OF FEES
Payment of fees shall be monthly, upon submittal by Consultant and appi

6. FINAL SUBMISSIONS
Within fifteen (15) days of completion and approval of the final pr

7. CHANGES IN WORK

8. CITY STANDARDS

11. TERMINATION OF CONTRACT
In the event of the Consultant's failure to prosecute, deliver, or pe

12. DISPUTES
If a dispute should arise regarding the performance of work under
agreement, the following procedure shall be used to resolve any question of

13. RESPONSIBILITY OF THE CONSULTANT
The Consultant is hired to render professional services as describ

Registered Traffic Engineer's license number.
14. SUSPENSION OR TERMINATION OF SERVICES
This agreement may be terminated by either party upon tendering thirtj
day written notice to the other party. In the event of such suspensi
termination, upon request of the City, the Consultant shall assemblc

17. OWNERSHIP OF DOCUMENTS
All traffic counts, calculations, reports and documents as herein reqi

19. ASSIGNMENT OF CONTRACT
The Consultant shall not assign the Contract or any part thereof o

20- SUBCONTRACTING
If the Consultant shall subcontract any of the work to be performed I
this Contract by the Consultant, Consultant shall be fully responsible tc

The Consultant shall file a Conflict of Interest Statement with the
Clerk of the City of Carlsbad in accordance with the requirements of the

26. INSURANCE
The Consultant shall obtain and maintain a policy of liability insui
from an insurance company authorized to be in business in the Statt

($1,000,000). This insurance shall be in force during the life of this agree

SCOPE OF WORK
GROWTH MANAGEMENT PLAN TRAFFIC MONITORING PROGRAM
The Consultant will obtain traffic counts on the surface streets intersections designated on Exhibit A-1. In addition, a monthly traffic r will be submitted that includes capacity and level of service calculatior a summary of traffic data obtained in the proceeding month. Traffic count: be collected during 1989 and obtained in the months of January or Februar again in July or August. All traffic counts and reports will be collecte prepared in accordance with the established performance criteria for count reports.
One orientation meeting will be held with the Consultant prior to the begi work. At that meeting the Consultant shall submit a time schedule for obta traffic counts and preparing the monthly report. Upon completion of the w counting program (January or February) and the summer counting program (Ju August), the Consultant will prepare the Annual Report in accordance wit performance criteria and submit the report in October 1989.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONSULTANT AGREEMENT FOR THE GROWTH
MANAGEMENT PLAN TRAFFIC MONITORING PROGRAM AND APPROPRIATING FUNDS.

WHEREAS, the Engineering Department of the City of Carlsbad b
proposals from qualified traffic consulting engineering firms to
traffic monitoring program of the Growth Management Plan; and,
WHEREAS, the City Council of the City of Carlsbad here
necessary, desirable and in the public interest to award a consult;
with JHK & Associates of San Diego, California to provide servic
project; and,
WHEREAS, the City of Carlsbad has previously collected Traffic
to fund said project,
NOW, THEREFORE, BE IT RESOLVED by the City of Carlsbad, C
fOllOWS:
1. That the above recitations are true and correct.
2. That the amount of $59,764 is hereby appropriate
1 unappropriated balance of the Traffic Impact Fund to Account Number
40-3316 for this project.
3. That a consultant agreement with JHK & Associates is her
and the Mayor and City Clerk are hereby authorized and directed to
