Adopt Resolution No. .S,Z waiving the insurance requirement
set forth in Council Policy #37 for the La Costa 35 Athletic
Club's Second Annual "Swing with your Heart Softball Tournament",
and temporarily waiving the Special Event liability insurance
requirement for other Carlsbad Youth and Adult sports
organizations.
Direct staff to review the problems currently being experienced
by user groups regarding compliance with Council Policy #37 and
return to the City Council with a report and recommendations.
ITEM EXPLANATION:
The La Costa 35 Athletic Club has requested the use of Stagecoach
Park on March 5, 11, and 12, 1989, for their Second Annual "Swing
with your Heart Softball Tournament". The proceeds of the
tournament will be distributed for the benefit of two injured
children (Exhibit 1).
Under Council Policy #37, the tournament would be classified as
a high hazard activity because it involves the service and sale
of alcoholic beverages (Exhibit 2). As a result, the club would
be required to provide two million dollar ($2,000,000) worth of
general liability insurance coverage.
The Club has requested that the City Council waive the general
liability insurance requirements because of the high cost of
acquiring the coverage and the difficulty they have experienced
in attempting to find a source to provide it.
As a matter of information, other user groups have also
complained about the difficulty they have experienced in
attempting to comply with the requirements of Council Policy #37
for their various events.
Due to the number of organizations currently experiencing
difficulty in complying with the liability insurance requirements
as outlined in Council Policy #37; it is recommended Council
consider a temporary waiver for other youth and adult sports
organizations. Additionally, it is recommended the City Council
direct staff to .review the existing policy and find a
satisfactory solution to the prob:sm created by the inability of
sports organizations to secu-_ Leasonable liability insurance
rates.
FISCAL IMPACT:
While there is no direct fiscal impact, substantial losses could
be incurred from any claims which result from uninsured
activities.
