CA TITLE: AMENDMENT OF LIST OF DESIGNATED EMPLOYEES CONTAINED IN THE LOCAL CONFLICT OF INTEREST CODE DEPT. HD.- CITY ATTYm CITY MGR- RECOMMENDED ACTION: Adopt the attached Resolution No. 84-sq updating Appendix 1 to the amended local conflict of interest code of the City of Carlsbad. ITEM EXPLANATION Government Code Section 87306 ofthe Political Reform Act requires that the City amend its local conflict of interest code whenever a change is necessitated by changed circumstances including the creation of new positions or duties assigned to existing positions. Designated employees are those employees who hold positions within the City which involve the making or participation in the making of decisions which may foreseeably have a material financial effect on any financial interest. Due to organizational changes and changed duties or responsibilities the list of designated employees has been revised to add the following positions: Building Maintenance Superintendent Assistant Director of Utilities and Maintenance Director of Utilities and Maintenance The position of Utilities Maintenance Manager has been deleted since it no longer exists. FISCAL IMPACT There will be a slight increase in additional staff time required to prepare an process disclosure forms for newly designated employees. WHEREAS, the City Council of the City of Carlsbad, California has adopted a local conflict of interest code which has been amended from time to time; and WHEREAS, Government Code Section 87306 of the Political Reform Act of 1974 requires that the City update its conflict of interest code whenever changes are necessitated by changed circumstances including the creation of new positions or relevant changes in the duties assigned to existing positions; and WHEREAS, the City has revised and updated its list of designated employees: and WHEREAS, the City Council of the city of Carlsbad has received and reviewed said list, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the revised list of designated employees in the attached amended Appendix 1 to the amended local conflict of interest code of the City of Carlsbad is approved. 3. RAUTENKRANZ, Cit9 Clerk ( SEAL ) AMENDED APPENDIX 1 TO THE AMENDED LOCAL CONFLICT OF INTEREST CODE OF THE CITY OF CARLSBAD The positions and categories within the City listed in this appendix are "designated positions." Any person whose position with the City is a designated position is a designated employee. Designated employees shall disclose in the manner provided in the Amended Local Conflict of Interest Code of the City of Carl sbad those financial interests which are within the categories represented by the letter(s) following the listed position. The letters correspond to the subsections of { 7 of 2 Cal. Adm. Code } 18730 and represent the following di scl osures: "A", investment and real property di scl osure ; "B" , personal income disclosure; "C", business entity income disclosure; "D", business position di scl osure. Conducts research and arrives at conclusions with respect to his or her renditions of information, advice, recommendations or counsel independent of control and directions of the Agency or of any Agency official, other than normal control monitoring; and B. Possesses no authority with respect to any Agency decisions beyond rendition of information, advice, recommendation or counsel.
