RECOMMENDED ACTION:
Authorize Development Consultants Consorti urn to prepare an amendment the Local Facilities Management Plan for Zone 20.
ITEM EXPLANATION
In February, 1987, a majority of property owners in Zone 20 petitioned ti City Council for permission to begin preparing the Local Facilitil Management P1 an (LFMP) and to designate Development Consultants Consort i
(DCC) as the preparer in accordance with Section 21.90.120(d) of t Carlsbad Municipal Code. This request was approved, DCC prepared t Plan, and it was adopted by the City Council on September 6, 1988.
The Plan as adopted followed the format of previously approved plan However, some property owners within the Zone have recently express( concern that the wording of two conditions is more restrictive than tt wording used in more recent zone plans. The property owners feel that tt current wording of these two conditions inhibits their ability to obta- pre-development approvals, as indicated in the attached letter from Howai Katkov (Exhibit 1). Therefore, the property owners are formal1 petitioning thee City Council for permission to amend the Plan and for D( to prepare the amendment.
Staff has no objection to re-opening this Zone Plan for amendment. Th process will be very similar to the process used to initially prepare th Plan. That is, all eleven public facilities will be reviewed to determin
whether amendment or updating is needed. The recommended amendments wil
then be presented in public hearing before the Planning Commission an City Council for approval.
Development Consultants Consortium has attempted to contact all of th property owners in Zone 20. Of the 39 owners in the Zone, 22 hav responded affirmatively, none opposed amending the Plan, 14 have no responded, and 3 could not be located. The responders constitute 56% o the property owners who represent 91% of the acreage (see Exhibit 2).
The Council’s action, if you concur, is to authorize DCC to proceed wit amendments to the Zone 20 LFMP.

At its meeting of S~ptemher 6, 1988 the City Council unanimousJ y adopted resolution number 88-323 approving the Zone 20 Locn 1 Faci 1 i ti es Management PI an (LFMP) . This plan was prepared as the result of a request initiated by the property owners and approved by the City Council. Set forth below is a request to amend the adopted Plan.
As adopted, the LFMP contains conditions which preclude

General Plan Amendments, Zone Changes and Tentative Maps prior
to the financing plan being adopted and the guarantees thereto
