Adopt Resolution No. 84- 77 accepting five (5) recorded grant d sewer and drainage purposes.
ITEM EXPLANATION:
As a condition of approval of CT 76-12 the developers of Calavera Hi
#1 were required to install a 12" and 18", off-site, sewer and storm serve their development. It appears that the required offsite easemet never granted or recorded. CT 76-12 was approved and recorded Decen and the sewer and storm drain were constructed during 1981.
In 1983 the City of Carlsbad approved CT 83-03. This subdivisi directly west of CT 76-12 and is the property that the off-site sewer drain for Cal avera Hills Unit #1 were constructed upon. Because the ur easements did not appear on title reports or the final map of CT 8: subdivision was approved without benefit of the easements being grar

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, ACCEPTING FIVE (5)
RECORDED GRANT DEEDS.
WHEREAS, Carl and Joanne Seelhoff, Joel Cannataro, Hans H.
Robert and Marilyn Hahnel, and Stephen and Bobette Seelig have sub'
deeds conveying easements to the City of Carl sbad for sewer and drain
over a portion of CT 83-03: and
WHEREAS, the City Council of the City of Carl sbad has determi
in the public interest to accept said deeds;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
California, as follows:

RE: CT 83-3
CT 83-3 (tentative map) was approved by the Planning Commission. This projc
is a 5 lot single family subdivision. The map was signed by the City Engint
and then recorded as a parcel map. Because all of the improvements were a11
in place, in accordance with the State Map Act, the requirement for final m:
was waived. Therefore, there was no final map to come forward to Council ar
we did not have a file for this project.
This information was given to me by Jim Murray who researched the matter afi
