DISCUSS A BAN ON THE SALE OF SEMI-AUTOMATIC WEAPONS IN CARLSBAD, AND
DIRECT STAFF TO RETURN WITH APPROPRIATE DATA AND DOCUMENTS FOR CITY
COUNCIL CONSIDERATION.
ITEM EXPLANATION:
A growing number of citizens have expressed concern about the sale of
semi-automatic weapons in Carlsbad. This agenda bill provides a forum for
discussion of this community concern.
FISCAL IMPACT:
None, other than staff time.

It is proposed that an agenda bill be prepared to ban the sale of semi-
automatic hand guns in Carlsbad. This is a growing community concern, and one I feel we need to address.
I would appreciate any comments or suggestions you may have regarding this issue.

Mr. Mamaux's proposed agenda bill specifically
mentions "hand guns", I believe this should be
expanded to include all semi-automatic weapons.
Even though it appears that the legal opinions
are coming down on the side that this is the
State's arena, I think we can help send a message
by passing our own ordinance.

The proposed agenda bill re 1 at i ng to the Prohibition on the Sa 1 e of Semi -
Automatic Handguns should be specific enough to include semi-automatic military
assault rifles (i.e. AK-47).
Additionally, the ordinance should prohibit possession, as well as sale of such
weapons.

RESOLUTION NO. 89-110
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA IN SUPPORT OF A STATEWIDE BAN ON THE SALE, POSSESSION
AND MANUFACTURING OF SEMI-AUTOMATIC ASSAULT WEAPONS.
WHEREAS, the City Council of the City of Carlsbad finds
6 and declares that the proliferation and use of semi-automatic assault
7 weapons poses a thre&t to the health, safety and security of all
8 citizens; and
9 WHEREAS, the City Council of the City of Carlsbad finds that law
10 enforcement agencies throughout Ca 1 ifornia report increased use of
11 assault weapons for criminal activities which has resulted in a record
' 12 number of homicides and injuries to citizens and law enforcement
13 officers; and
14 WHEREAS, the City Council of the City of Carlsbad finds that semi-
15 automatic assault weapons, which are capable of rapid rate of fire as
16 well as a capacity of fire an inordinately large number of rounds without
17 reloading are designed primarily for military or antipersonnel use.
18 Sports and recreational firearms are not included in the category of
19 banned assault weapons.
20 I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
21 Carlsbad, as follows:

That Assembly Bill 357 and Senate Bill 292 banning the sale,
and manufacturing of semi-automatic assault weapons be

3. That the Governor of California be urged to approve
legislation banning the sale, possession and manufacturing of semi-
automatic assault weapons.
4. That without statewide legislation, a citywide ban of the
sale, possession and manufacturing of semi-automatic weapons be
considered by the City Council.
PASSED, APPROVED AND ADOPTED by the Carlsbad City Council at a
regular meeting thereof held on the 28th day of March , 1989, by the
following vote, to wit:
