Rr RECOMMENDED ACTION: DEPT: HD., CITY ATTY CITY MGk Staff recommends Council adopt Resolution df/d , awarding the contract for weed abatement to Ingold Tractor Service. The City Fire Department annually -_ spects all property in the city as part of the Weed Abatement Program. Property owners with hazardous overgrowth of weeds or accumulation of trash and debris are notified to clear their lots. If the property owner fails to clean the property, the Fire Department, through the use of a private contractor causes the property to be cleaned, and the property owner is billed for the costs involved. Specifications for the Weed Abatement Program were developed by the Fire Department. In accordance with Section 3.28.120 of the Municipal Code, Notice to Bidders was published and Request for Bids was mailed to seventeen contractors. Two responses were received, opened, witnessed and recorded on April,4 1989. The lowest responsive bidder for the contract was submitted by Ingold Tractor Service, 4135 Park Drive, Carlsbad, California 92008. Although Council has not adopted the 1989-90 operating budget, the weed abatement program starts June 1, 1989. Last year's program cost $30,050 and it is anticipated that funds in the amount of $45,000 will be provided in next year's budget for this program. Blade Work per Hour 65 Tractor mowing per Hour 50 $ 28 31 35 38 $ 28 31 35 38 $ 16 14 13 21/hr. .03/sq.ft. 52 $ 30 19 EXHIBIT "B" AGREEMENT (WEED ABATEMENT) THIS AGREEMENT, made and entered into this c4Cday of 1989, by and between the City of Carlsbad, a municipal corporation (hereinafter called "City") and Ingold Tractor Service (hereinafter called "Contractor"). 00-VIORKPOW" WHEREAS, the City Council of the City of Carlsbad, pursuant to Section 39560 et. seq. of the Government Code, has determined that a Weed Abatement Program is in the public interest; and WHEREAS, public interest requires that the City enter into this agreement with the Contractor to complete said program; and WHEREAS, the Contractor is willing to abate said weeds in the manner hereinafter provided; and WHEREAS, the terms and conditions, specifications and addendum thereto, accurately and fully describe that the Contractor is willing to furnish the labor and materials to abate said weeds and clean said property as called for by said specifications and said proposal and the manner and time within which the same shall be accomplished; I 3 NOW THEREFORE, in consideration of the premises and of the covenants herein contained; IT IS AGREED BY AND BETWEEN THE PARTIES as follows: (1) Said specifications, terms and conditions and addendum thereto, filed with City Clerk, as aforesaid are made a part hereof, and that the same do, in all particulars, become a part of the agreement and contract between the parties hereto in all matters and things set forth therein and described, and that both parties hereto, hereby Rccept and agree to the terms and conditions of said specifications and addendum thereto, and bonds so filed. (2) The Contractor agrees to perform the work in the manner set forth in said specifications and addendum thereto and the City agrees to pay for said work after completion at the prices set forth as follows: (Bid Proposal as submitted by Contractor) . (3) The Contractor shall indemnify and defend the save harmless the City of Carlsbad, its off icers, agents and employees from and against any and all claims, demands, loss or liability of any kind or nature which the City of Carlsbad, its officers, agents and employees may sustai o incur n or which may be imposed upon them or any of them for injury to or death of persons or damage to property arising out of or in any manner connected with the negligence or lack of care of Contractor, his officers, agents or employees in the performance of this contract. This provision shall include 1 2 41 any and all claims arising from sub -contractors retained by the Contractor. (4) The Contractor hereunder shall commence work at the time f ixed by the Fire Chief and the entire work contemplated hereunder be completed by July 24, 1989. Time shall be deemed of the essence regarding this contract, and Contractor shall be equipped to commence work on ten (10) days written notice from Fire Chief. No extension of time beyond the time of completion herein mentioned will be granted except by the Fire Chief (unless otherwise directed by the City Council) for good cause. (5) This agreement may be terminated by either party by giving ten (10) days written notice to this action, and this agreement shall terminate ten (10) days following if such notice is given. (6) The term of this agreement shall be for a period commencing on the date of this agreement and terminating on December 31, 1989, or such later date as may be required f or the contractor to complete the work set f orth in the specif ications. This agreement may be extended f or three (3) additional periods for a total of four (4) years, upon satisfactory performance. 1 3 IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed by their officers thereunto duly authorized, and their seals to be hereunder affixed. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute an agreement, a copy of which is attached hereto marked Exhibit "B" for and on behalf of the City of Carlsbad.
