SUBJECT: SUGGESTED LEGISLATION REGARDING INCREASED
PENALTIES FOR NARCOTIC VIOLATIONS
An effective war on drugs must focus not only on education, but must
also include tough penalties for those who abuse and/or traffic in drugs.
While much is being done in the area of education, much needs to be
done to make the penalties for narcotic violations commensurate with
the harm caused to society by continued drug abuse.
The decision to sell drugs is largely an economic one. The would be
drug seller must weigh the risks involved (i.e. penalties) with the
large amount of money which can potentially be earned. Since the
penalties for trafficking in drugs are minimal in California, it is easy
to understand why this risk-benefit analysis causes many to opt to violate
the law. The would be drug dealer knows that not only must he be
caught, but if he is apprehended and if he can be successfully prosecuted,
the penalty ranges are minimal. -
Our State needs to take a tough no-nonsense approach. If we are
serious about this problem then our laws should reflect this. Those
who abuse and/or traffic in drugs must know that substantial penalties
await them. Our Legislature has done much in recent years to increase
penalties for crimes of violence. The Legislature needs to take an equally
tough stand on this issue.
For these reasons the following changes in State law will be recommended
for consideration by the Alcohol and Drug Prevention Task Force (ADAPT):

This section makes sale of more than 1 oz. of cocaine or
methamphetamine a presumptive State Prison sentence.
This statute should be amended to also make offering to
sell a presumptive State Prison sentence.
H&S 11106(f)
Saler or possession, without a permit, of raw chemicals needed to
produce controlled substance is punishable as a misdemeanor or
16 mo., 2 years or 3 years in State Prison. This section should
be a straight felony with a sentencing range of 3 years, 5 years
or 7 yeai-s in State Prison.

OTHER STATUTES -Continued:
P. C. 1000 Drug Diversion
Present law allows for a pending case to be suspended for up
to 2 years to determine whether a qualified defendant can successfully
complete a drug diversion program. If the defendant succeeds
the case is dismissed, but if the defendant fails the case is
reinstated and the District Attorney is forced to prosecute a case
which may be up to two years old. A better approach would be
to require a guilty plea as a condition of entering the diversion
program. If the defendant succeeds the guilty plea is set aside,
but if the defendant faiis the court only needs to sentence him
for the underlying offense.
