EIR 86-2- ADOPT Resolution No. m - I?% , authorizing the Mayor to e amended agreements with Fieldstone/La Costa Associates ar consulting firm of STA, Inc. to provide additional environ consulting services for the Arroyo La Casta Master Plan projec ITEM EXPLANATION In August, 1988 Council adopted Resolution No. 88-310 apF amended agreements with the La Costa Ranch Company and with ST2 to provide an EIR for the revision of the Zone 12 area of the Lz Master Plan along with an implementing Tentative Map and Plannc Development. A substantial amount of work has been comg However, due to unforeseen complexity of the projects, an augn the agreement is necessary. A good portion of this increased complexity has been outside agreement's original scope. For example, the status of the C Enchitas' circulation system has only recently become clear Master Plan projects are adjacent to the City of Encinitas a influenced by their circulation system. In addition, Carl review of open space issues has complicated the analysis of the Plan projects. These events along with an expanded design process has necessiated additional analysis. FOR PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT FOR THE MASTER PLAN PROJECT The City Council of the City of Carlsbad, Califor does hereby resolve as follows: 1. RAUTENKRANZ, City Clkrk e EXHIBIT AGREEMENT e THIS SUPPLEMENTAL AGREEMENT is made this 20th day of June 1989, between the CITY OF CARLSBAD, a municipal corporation of the Sta California, hereinafter referred to as CITY, and the FIELDSTONE/LA ASSOCIATES (La Costa Ranch Company) hereinafter referred to as APPLI pursuant to Article 4, of that certain agreement between the parties dated 9, 1986, which is on file with the City Clerk ("original agreement") supplemental agreement dated August 25, 1988 ("supplemental agreement"). Except as set forth below, all terms conditions of the original agreement and supplemental agreement shall remair effect for the balance of the term of this Agreement. The original agreement and supplemental agreement shall supplemented and amended as provided for bel ow: As of May 16, 1989, $76,262.50 has been paid to STA, Inc. for preparation of the environmental impact report for the Arroyo La Costa Mas Plan. The remaining $59,903.00 shall be paid in the following manner: 1. Up to $43,023.00 shall be paid within 15 days of the rece of invoice for work completed. 2. $5,940.00 shall be paid within 15 days of receipt of Respo to Comments documents. 3. $5,940.00 shall be paid within 15 days of receipt of invc after final City approval of the environmental impact report. 4. $5,000 shall be kept as a c4ingency fund which shall on14 paid upon written request from the consultant showing additional City authori time and materials and written authorization of the Planning Director of the C of Carlsbad.
