RECOMMENDED ACTION:
Adopt Resolution No. Qf~ /?/, declaring the results of the Special Municipal
Election held June 6, 1989.
ITEM EXPLANATION
The Registrar of Voters has canvassed the returns of the Special Municipal Election
held on June 6, 1989. The certificate showing the results of that canvass is
attached as Exhibit "A" to Resolution No. $?- 'if 1 .
The attached resolution declares the following election results:
Proposition F (Increasing the Transient Occupancy Tax Rate from 8% to 10%)
passed, and Ordinance No. NS-52 is hereby adopted.
Proposition G (Approving the expenditure of City funds for construction of two
public golf courses, a multi-court tennis complex, two multi-purpose fields and
an enclosed soccer field) was approved by the voters.

RESOLUTION NO.89-197
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, RECITING THE FACT OF A
SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON
THE 6TH DAY OF JUNE, 1989, DECLARING THE RESULTS
THEREOF AND SUCH OTHER MATTERS AS ARE REQUIRED
BY LAW.

WHEREAS, a Special Municipal Election was held and conducted in the City

of Carlsbad, County of San Diego, State of California, on Tuesday, the 6th day
7
of June, 1989, as required by law; and
8
WHEREAS, notice of said election was duly and regularly given in time, form
9
and manner as provided by law, that voting precincts were properly established,
10
that election officers were appointed, and that in all respects said election
11
was held and conducted and the votes cast thereat, received and canvassed and
12
the returns made and declared in time, form and manner as required by the
13
provisions of the Election's Code of the State of California for the holding of
14
elections in cities; and
15
WHEREAS, City Council Resolution No. 89-58, adopted on the 7th day of
16
March, 1989, authorized the Board of Supervisors of the County of San Diego to
17
canvass the returns of said election; and
18
WHEREAS, pursuant to the Election's Code said canvass has been completed
19
by the Registrar of Voters, who has conducted the canvass, said certificate is
20
attached as Exhibit "A".

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
22
California, as follows:23
1. That the above recitations are true and correct.

2. That the whole number of ballots cast in said City was 7,834.
25
3. That the measures voted upon at the election are as follows:

PROPOSITION F: Shall Ordinance No. NS-52 be adopted amending Chapter
3.12 of the Carlsbad Municipal Code to increase the Transient Occupancy
Tax rate from 8% to 10%?28
1 PROPOSITION G: Do the voters of the City of Carlsbad approve spending
City funds from various sources including the General Fund in an amount
2 over One Million Dollars as determined necessary by the City Council
to construct two public golf courses, one regulation and one short
3 course, a multi-court tennis complex, two multi-purpose adult size
fields, and an enclosed soccer facility? This measure authorizes but
4 does not require such construction and may include the expenditure of
funds for property acquisition.

4. That the number of votes given at each precinct and the number of votes
6
for and against the measures, were as listed in the attached Exhibit "A".

5. The City Council does declare and determine that:

(a) As a result of the election, a majority of voters voting on
9

Proposition F relating to increasing the Transient Occupancy Tax
rate from 8% to 10% did vote in favor of it, and that Proposition
F and Ordinance No. NS-52 shall be deemed adopted and ratified.
(b) As a result of the election, a majority of the voters voting on
Proposition G relating to approving the expenditure of City funds
for construction of two public golf courses, a multi-court tennis
complex, two multi-purpose fields and an enclosed soccer facility
did vote in favor of it, and that Proposition G shall be deemed
adopted and ratified.

6. The City Clerk shall enter on the records of the City Council of the

City, a statement of the result of the election showing: (1) The whole number
16
of ballots cast in the City; (2) The measures voted upon; (3) The number of
17
votes given at each precinct for and against each measure; and (4) The total
18
number of voters given for and against each measure.19

7. That the City Clerk shall certify to the passage and adoption of this
resolution; and enter it into the file of Original Resolutions.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of
the City of Carlsbad on the 27th day of June, 1989, by the following vote, to
wit:
AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson
NOES: None
ABSENT: None

ORDINANCE NO. NS-52

AN ORDINANCE OF THE CITY OF CARLSBAD, CALIFORNIA,
2 AMENDING TITLE 3, CHAPTER 3.12 OF THE CARLSBAD
MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS
3 3.12.030 TO INCREASE THE TRANSIENT OCCUPANCY TAX
RATE FROM 8% TO 10%.
4 The People of the City of Carlsbad do ordain as follows:

SECTION 1. That Title 3, Chapter 3.12 of the Carlsbad
6
Municipal Code is amended by the amendment of Section 3.12.030
7
to read as foI Iows:
8
"3.12.030 Imposition -- Amount -- Where payable.
9 For the privilege of occupancy in any hotel, each
transient is subject to and shall pay a tax in the
10 amount of nine percent of the rent charged by the
operator. After January 1, 1990, the tax shall be
11 ten percent for such rent. The tax constitutes a
debt owed by the transient to the City which is
12 extinguished only by payment to the operator or to
the City. The transient shall pay the tax to the
13 operator of the hotel at the time the rent is paid.
If the rent is paid in installments, a proportionate
14 share of the tax shalI be paid with each instalIment.
The unpaid tax shalI be due upon the transient's
15 ceasing to occupy space in the hotel. If for any
reason the tax due is not paid to the operator of the
16 hotel, the tax administrator may require that such tax
shall be paid directly to the tax administrator."

SECTION 2. The City Council may amend this ordinance from
18
time to time to add exceptions, or adjust the rate, or
19
application of tax, or make such other changes as they determine
20
to be necessary provided the rate of tax to be imposed by this
21
ordinance shall not be increased.

SECTION 3. In accordance with Section 4013 of the
23
Elections Code of the State of California, this Ordinance shall
24
be considered as adopted upon the date that the vote is
25
declared by the City Council and shall go into effect ten (10)
26
days after that date.
