RECOMMENDED ACTION:
Adopt Resolution No. 89-237approving Change Order No. 28 for tl construction of the Carlsbad Senior Center and Carlsbad Unifi School District Education Center, Project No. 3247.
ITEM EXPLANATION:
Attached for the City Council's review and approval is Change Ord No. 28 for the Carlsbad Senior Center and Carlsbad Unified Scho District Education Center Project currently under construction Pine Avenue. This change order is a result of recently complet negotiations between the contractor and their legal counsel as WE as City staff, the City's construction management consultants, a the City Attorney's office.
Because of the discovery of previously unknown, unforese subsurface hazardous materials in the form of an abandoned kerosc tank on the Pine Avenue site last October, clean-up E administration of this condition required the construction schedt for the project to be extended. A summary of the project stat in terms of time is as follows:

The corresponding effect of the kerosene tank discovery upon extension to the schedule resulted in the contractor and seve sub-contractors performing construction activities including s grading, foundation trenching, installation of structural ste structural concrete, and site clean-up in an historically wet period of the year. These activities would normally have occur during the months of October and November and not December January had the schedule not been extended as a result of kerosene tank discovery. With the site exposed during the ra period, substantial additional work was required and valuable t lost on the project's critical path schedule. The contrac encountered, therefore, more difficult site conditions result in additional project costs and lost time.
After lengthy consideration of this item and upon the advice of City's construction management consultants for this project, contractor's claim for additional project costs was negotiated resolved at a recent meeting. Staff recommends approval of attached Change Order No. 28.

FISCAL IMPACT:
Change Order No. 28 totals a negotiated settlement of $42,000 ai a contract time extension of 29 calendar days as a result of tl impacts and costs to the project from the previously unkna subsurface kerosene tank discovery. A sufficient balance of fun1 currently exists in the project's construction contingency ' enable approval of this change order at this time.
All costs associated with the unknown, unforseen subsurfa hazardous waste conditions on the Pine Avenue site are unbudget project expenses currently being absorbed in total by the project construction contingency account. Additional funds may be requir to complete all final elements of the Senior Center Project. Sta will return with a detailed project update and accounting in t near future when the current ongoing contractor/City negotiatic produce a more clearly defined financial status.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING CHANGE ORDER NO. 28 FOR THE CONSTRUCTION OF THE CARLSBAD SENIOR CENTER AND CARLSBAD UNIFIED SCHOOL DISTRICT EDUCATION CENTER, PROJECT NO. 3247
WHEREAS, the City Council of the City of Carlsbad, Calij

WHEREAS, said project is currently under construction;
WHEREAS, additional work and time required of said proje
