RECOMMENDED ACTION: Adopt Resolution No. fFzf’9 approving plans and specifications and
authorizing the City Clerk to advertise for bids for the
construction of the Rancho Carlsbad and El Camino Real traffic
signal system, Project No. 3317.
ITEM EXPLANATION:
In the 1988-89 Capital Improvement Program budget, the City Council
appropriated funds for the construction of a traffic signal system
at the intersection of Rancho Carlsbad and El Camino Real.
Construction is anticipated to require approximately ninety (90)
calendar days from the date of the issuance of the Notice to
Proceed. Staff recommends approval of the project plans and
specifications and requests authorization to proceed to bid forthe
installation of this signal.
Also attached for the Council’s approval is an encroachment
agreement with the owner’s of the Rancho Carlsbad Mobile Home Park
allowing the City to install and maintain certain wiring, poles,
and signal loops required of the signal system installation on
adjacent private property. Staff recommends approval of the
encroachment agreement.
FISCAL IMPACT:
Funds in the amount of $100,000 have been appropriated in the 1988-
89 Capital Improvement Program budget and are available in Account No. 300-820-1840-3317.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING THE CITY CLERK
TO ADVERTISE FOR BIDS AND AUTHORIZING THE
MAYOR TO EXECUTE AN ENCROACHMENT AGREEMENT FOR
THE CONSTRUCTION OF THE RANCHO CARLSBAD AND
EL CAMINO REAL TRA FFIC SIGNAL, PROJECT NO. 3317
WHEREAS, the City Council of the City of Carlsbad,
California, has determined it necessary and in the public interest
to construct Rancho Carlsbad and El Camino Real traffic signal;
and
WHEREAS, plans and specifications for the furnishing of
all labor, materials, tools, equipment, transportation and other
expenses necessary or incidental for said project, have been
prepared and are on file in the Municipal Projects Department of
the City of Carlsbad; and
WHEREAS, funds in the amount of $100,000 are available
in the account #300-820-1840-3317.
NOW, THEREFORE, BE IT RESOLVED by the City of Carlsbad,
California, as follows:
1, That the above recitations are true and correct.
2. That the plans and specifications as presented are
hereby approved.
3. That the City Clerk of the City of Carlsbad is
hereby authorized and directed to publish, in accordance with law,
Notice to Contractors inviting bids for the construction of the
Rancho Carlsbad and El Camino Real traffic signal.

4. That the Mayor is hereby authorized to execute an
encroachment agreement for the installation of said signal.
Following the Mayor's signature of said agreement, the City Clerk
is hereby authorized to record said agreement and to forward copies
of the recorded document to the Municipal Projects Department.
PASSED, APPROVED AND ADOPTED by the City Council of the
City of Carlsbad at its regular meeting held on the 18th day of
July , 1989, by the following vote, to wit:

ENCROACHMENT AGREEMENT
The undersigned, the owner of Rancho Carlsbad Mobil Home Park, in the City of Carlsbad, County of San Diego, State of California, in consideration of the Grant of Permission by the owner to install and maintain traffic signal loops, wiring, and poles at the intersection of El Camino Real and Rancho Carlsbad Drive for the use and benefit of owner's property.
1. The above signal shall be installed and maintained by the City at no cost to the Owner.
2. The Agreement is made for the direct benefit of Owner's
land above described and the covenants and conditions
herein contained shall run with said land shall be
binding on the assigns and successors of Owner.
