ITEM EX PLANATI ON Representatives of the Carlsbad City Employees' Association (CCEA) and the City have reached agreement regarding wages and other terms and conditions of employment for a two year period beginning July 10, 1989, through June 30, 1991. The agreement provides for the following salary increases: July 10, 1989 An average of 5% applied to new salary schedule + lump sum payments. July 1990 4% salary January 1991 2% salary FISCAL IMPAC T Cost of salary adjustments and related benefits is $407,624 to be supported by transfers from the Housing Fund ($3,272), Redevelopment Fund ($1,868), Sanitation Fund ($11,225), Vehicle Maintenance Fund ($7,536), Street Lighting Fund ($5,995), Data Processing Fund ($9,003), Senior Citizens Fund ($1,556), and the General Fund Contingency Account ($354,656) to the appropriate department salary accounts. The General Fund Contingency Account balance will be reduced to $1,345,344. WHEREAS, representatives of management and the Carlsbad City Employees' Association, have been conducting negotiations pursuant to the Meyers-Millias-Brown Act, regarding wages and other terms and conditions of employment for the period July 10, 1989, through June 30, 1991; and WHEREAS, said representatives have reached agreement which they desire to submit to the City Council for approval: and WHEREAS, the City Council has determined it to be in the public interest to accept such an agreement in the form of a Memorandum of Understanding, marked Exhibit A and incorporated by reference herein; WHEREAS, funds for this salary adjustment are available in the City's contingency account and other fund balances. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Memorandum of Understanding between the Carlsbad City Employees' Association and representatives of management is hereby accepted. 3. RAUTENKRANZ, City Cl-k (SEAL) I EXHIBIT A HEHORANDUH W UNDERSTANDING between the City of Crr lsbrd and the Clrlsbrd Clty Employees' Assoclrtlon This Memorandum of Understanding is made and entered into between designated management representatives of the City of Carlsbad (hereinafter referred to as the 'City'), and he designated representatives of the Carlsbad City Employees' Association (herelnafter referred to as CCEA). It is the purpose of this Memorandum of Understanding (hereinafter referred to as 'Memorandum') to promote and provide for harmonious relations, cooperation, and understanding between the City Management representatives and the miscellaneous employees covered under thls Memorandurn, as shown on Attachment A; to provide an orderly and equable means of resolving any misunderstandings or dlfferences which may arlse under thls Memorandum; and to set forth the agreement of the parties reached as a result of good faith negotiations regarding wages, hours, and other terms and conditions of employment of the employees covered under this Memorandum, which agreement the parties intend to jointly submit and recommend to the City Council for its determination. Article 1 Recognl tlon The City of Carlsbad recognizes CCEA, as representative for all classlfications in this Unit, as set forth in Attachment A. Artlcle 2 Implementation This Memorandum constitutes a mutual recommendation to be jointly submitted to the City Council subsequent to the ratification of the Memorandum by the membership of CCEA. It is agreed that this Memorandum shall not be binding won the parties either in whole or In part unless and until: A. The Clty Councll acts, by msJorlty vote, formally to approve and adopt said mMldum; or 6. The City Council acts to appropriate tho necessary funds required to implement the prwlslons of thls Memorandum; or C. The Clty acts in a tlmely manner to make the changes in Clty ordinances, resolutions, rules, policies and procedures necessary to implement this Memorandum. Article 3 Term The term of this Memorandum shall commence on the date when the terms and conditions for its effectiveness, as set forth in Implementation, are fully met. Notwithstanding the above, if federal or state governments take action that has direct effect upon areas which fall within meet and confer, the Clty may submit proposals concerning these areas at later dates. Article 5 Retention of Benefits The employees of the City of Carlsbad shall retain all present benefits for the term of !his agreement, except as amended by this Memorandum. Article 6 City Rights The rights of the City include, but are not limited to the exclusive right to determine mission of its constituent departments, commissions, boards; set standards of service; determine procedures and standards of selection for employment and promotion; direct its employees; take disciplinary action; relieve its employees from duty because of lack of work or other legitimate reasons; maintain the efficiency of governmental operations; determine the methods, means, and personnel by which government operations are to be conducted; determine the content of job classifications; take all necessary actions to carry out its mission in emergencies; and exercise complete control and discretion over its organization and the technology of performing its work Article 7 No Strike md No Lockout A. No Strike. During the life of this Agreement, neither the employees nor any agents or representatives will instigate, promote, sponsor, engage in, or condone any strike (including sympathy strike), slowdown, concerted stoppage of work, sickouts, or any other lntentlonal disruption of the operations of the City, regardless of the reason for so doing. 8 instigates or gives leadership to such activity, shall be subject to disciplinary action. Artlcle 8 Compensrtlon Adlustmcnts A Annual Salary adjustments Salary increases in accordance with the schedule below will be made, effective the first pay period begining in the month indicated, fnr ail represented Classifications by applying the mc-me to Step A of the New Salary Range Schedule Julv, 1983. 5% + Lump Sum Payment as provided for in Section C January, 199 1. 2% July, 1990 4% 6. Salary Range Schedule Effective the first Pay period in July, 1989, the Salary Range Schedule attached hereto (Attachment B) shall be implemented. Employees in existing salary ranges shall be placed into the new ranges in the same Step that they are in currently. The annual salary adjustment. effective the first pay period in July, 1989, shall then be applied to the new salary range schedule and a new Attachment 6 w ill be es tab1 I shed. C Lump Sum Payments In the Same pay period the July 1989 salary increase IS implemented, the City shall provide each employee represented by this agreement a special one-time lump sum payment in accordance with the schedule below. The following is based on the Employee Salary Range Placement listing dated July 12, 1989 Note this list will be up-dated to reflect the agreed to adjustment and current emplovee status. 1. Those employees receiving a salary increase with a Percent Change that is less than 3 5% shall receive a lump sum payment of $900. 2. Those employees receiving a salary increase with a Percent Change that IS 3S% but less than 3% shall receive a lump sum payment of $775. 3. Those employees receiving a salary increase with a Percent Change that is 48 but less than 5% shall receive a lump sum payment of $SlS 4. Those employees receiving a salary increase with a Percent Change that is 5% but less than 6% shall receive a lump sum payment of $260. D. Tool Allowance. The City will meet informally with the Equipment Mechanics for the purpose of developing a personal tool usage & allowance policy. As a part ot' this policy, the City will establish an annual tool allowance for employees to purchase and maintain personal tools used in the normal course of employment on City premises. Artkle 9 Health Insurance Program A. The current plans known as "Kaiser" and "Northwestern" which provide medical, dental and vision coverages for employees and their dependents will continue to be available to employees during the term of this Memorandum. If a change in insurance carrier is necessary, as determined by the City, the City will notify CCEA. B. The followiny contribution shedule shall be applied to the health plan premiums: -3- Cateaorv Citv Contribution EmDlovee Contribution "western Kaiser "western Kaiser Employee Only !OO% 100% 0% 0% Employee + 1 Dependent 96% 100% 4% 0% Employee w/ 2 + Dependents 93.7% 100% 6.3% 0% Article 10 Communications T!v parties agree to ccntinue rneetmg at least once each month during the term of this Agreement for the purpose of continuing communications on subjects of mutual concern Article 11 Annual Vacation Leave The following shall be the annual vacation leave schedule: 1 through 5 full calendar years of continuous service - 10 working days 6 through 10 full calendar years of continuous service - 15 working days 10 through 11 full calendar years of continuous service - 16 working days I 1 through 12 full calendar years of continuous service - 17 working days 12 through 13 full calendar years of contlnuous service - 18 worklng days 13 through 14 full calendar years of continuous service - 19 working days 14 through 15 full calendar years of continuous Service - 19 working days 16 and over full calendar years of continuous service - 20 working days Article 12 Bereavement Leave A. An employee may use up to 24 hours of paid leave if required to be absent from duty due to the death of a member of the employee's immediate family. Additional time off may be authorized by the department head and charged to accrued vacation or treated as leave without pay. The "immediate famlly" shall be deflned as: Spouse, child, parent, slbling, grandparents; the aforementioned either natural, step or in-law, or any person over whlch the employee acts as legal guardian, or a veriflable current member of the immediate household. B. The employee may be required to submit proof of relative's death before final approval of leave with pay is granted. Article 13 Associrtlon Deductions Parties agree that upon formal notice from CCEA and employee authorization, the City shall withhold deductions in amounts designated by CCEA members providing changes do not occur more frequently than once each flscal year. Artlcle 14 State Dlsability Insurance The City agrees to continue premium payments for state disability insurance during the term of this agreement. Article 15 Holidays A The City shall observe eleven i 1 1) scheduled paid holidays plus one (1 1 floating holiday for employees assigned to eight-hours-per-day-five-days-per-week workweeks. and nine (9) scheduled holidays plus one (1 1 floating holiday for emplovees -4- asslgned to ten-hours-gerday-fourdays-per-week workweeks. The floatlng holiday may be used at the discretion of the employee with prior approval of the Department Head B. The scheduled pald holldays that will be offlclal City holidays for the term of this agreement shall be as follows: New Year's Day Columbus Day Llncoln's BlrVlday Veteran's Day Washington's Birthday Thanksglving Day Memorial Day Thanksglving Friday Independence Day Christmas Day Labor Day The Clty shall annually develop and publlsh a hollday schedule whlch wlll ldentlfy the specific days on which the above holidays wlll be observed as official Clty holidays and whlch days will not be observed for employees on ten-hours-perday-fourdays-per- week workweeks. Articlo 16 Full Unhrshding, Hdiflcrtlon. Wrlwr A. Thls Memorandum of Understandlng sets forth the full and entlre understandlng of matters contalned hereln, any other prlor or exlstlng understandlng or agreements by the partles, whether formal or informal, regarding any such matters are hereby superseded or termlnated In thelr entlrety. B. It 1s the Intent of the partles that thls Memorandum of Understandlng be administered in its entlrety in good faith during its full term. Durlng the term of thls agreement it may be necessary for the Clty to make changes relatlve to the hours, wages, terms and condltlons of employmt or chsnges in rules or procedures affecting the employees covered by his agreement. Where the City flnds It necessary to make such changes, It shall notlfy CCEA lndlcatlng the proposed change prior to its implementation. If CCEA wishes to consult or meet and confer with the Clty regardlng the matter, CCEA shall notify the Clty wlthin flve (5) working days from the receipt of such notlce. Upon receipt of such notlce, the parties shall meet promptly In an earnest effort to reach a mutually satlsfactory resolution of any problem arising as a result of ths change instituted by the Clty. Where ths Clty makes such changes because of the requirements of the law, the City shalt not be requlred to negotlate the matter of comgllance wlth any such law. Except as speciflcally provided herein In paragraph B, lt is agreed and understood that each party hereto voluntarily and wrqualifledly waives its right, and agrees that the other shall not be required, to negotiate wlth respect to any other matters wlthln the scope of negotlatlons, durlng the term of thls Memorandum of Understsndlng. -5- . --- E. Any agreement, alteration, underctmdinq, vriation, waiver or modification of any of the terms or provlslons contalned hereln shall not be blndlng upon the parties hereto unless made and executed in writing by all parties hereto, and if required, approved and implemented by the Clty Council. F. The waiver of any breach, term or condition of this Memorandum of Understanding by either party shall not constitute agreement or precedent in the future enforcement of all its terms and provisions. Artlcle 17 Authorized Agents For the purpose of administering the terms and provisions of this Memorandum of Under stonding : A. City's prlncipal authorized agent shall be the City Manager or a duly authorized representatlve (Address: 1200 Elm Avenue, Carlsbad, Callfornla 92008; Telephone (6 19) 434-2859), except where a particular City representative is specifically designated in connectlon with the performance of a speclflc functlon or obligation set forth herein. 8. CCEA authorized representative shall be its Presldent or duly auborized representatlve (Address: P.O. Box 2056, Carlsbad, Callfornla 92008; Telephone (619) 729-8128). Artlclo 18 Prodslons of Law It is understood and agreed that this Memorandum of Understandlng is subject to all current and future appllcable federal and state laws, federal and state regulatlons. If any part or provision of the Memorandum of Understanding is in conflict or inconsistent wlth such above applicable laws, rules and regulations, or is otherwise held to be invalid or unenforceable by any tribunal or competent jurisdiction, such part or provlsion shall be suspended and superseded by such appllcable law or regulatlons, and the remainder of thls Memorandum of Understandhg shall not be affected thereby.
