RECOMMENDED ACTION:
Adopt Resolution No. s'jd?8 accepting a Grant Deed for waterline purpos
ITEM EXPLANATION:
As a condition of approval of Building Permit 87-145 the owner, Motel 6 required to dedicate an easement across their property for the purposl installing public onsite fire hydrants and waterlines. The subject prop is located on the northeast corner of Raintree Drive and Avenida Encinas. satisfy the condition of approval Motel 6 is offering the attached deed Counci 1 acceptance.
Engineering Staff has reviewed the grant Deed and finds it satisfactorj its intended purpose.
FISCAL IMPACT:
Requiring dedications as a condition of development will save the City expt in future easement acquisitions.

This is to certify that the interest in real property
conveyed by the deed or grant dated January 30, 1989

RESOLUTION NO. 89-278
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED.
WHEREAS, Motel 6 has submitted a Grant Deed conveying an easemen
City of Carlsbad for waterline purposes over a portion of Lots 2 a
Carlsbad Tract 81-05; and
WHEREAS, the City Council of the City of Carlsbad has determined
in the public interest to accept said Deed;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of C
California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed from Motel 6 dated January 30, 1989, c(
an easement for waterline purposes over a portion of Lots 2 and 7 of (
Tract 81-05 to the City of Carlsbad which is on file with the City Clerl
incorporated herein by reference, i s accepted.
3. That the City Clerk is authorized to cause the original De(
recorded in the Office of the County Recorder of San Diego County, 5
California, with the appropriate Certificate of Acceptance attached.
