Adopt Resolution No. <?*dfY authorizing an amendment to
agreement with Darrell E. Waters for construction administrai
services for the Carlsbad Senior Center and Carlsbad Unified Scl:
District Education Center, Project No. 3247.
ITEM EXPLANATION:
The City Manager entered into a contract with Darrell E. Water:
provide construction administration, construction managemc
claims administration, construction scheduling, and rele
administrative and technical functions for the construction of
Carlsbad Senior Center and Carlsbad Unified School Distr Education Center, in an amount not to exceed $10,000. Due to
magnitude and complexity of the project dealing with cla
administration services and contractor claims negotiations,
original contract has been exhausted.
The original contract allows continued retention through -
express written approval of the City. Under Purchasing Ordinal
3.28.170, all contracts for services in an amount of $15,000
more shall be awarded by the City Council. An amendment to .
original contract with Darrell E. Waters for an additional $15,1
is required.
FISCAL IMPACT:
Sufficient funds are available in the Miscellaneous Professior
Services Account #001-820-3130-2479 to cover this change.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AUTHORIZING
THE EXECUTION OF AN AMENDMENT TO THE
CONSULTANT AGREEMENT FOR CONSTRUCTION
ADMINISTRATION OF THE CARLSBAD SENIOR
CENTER TO INCREASE THE PAYMENT TO THE
CONSULTANT
The City Council of the City of Carlsbad, California,
hereby resolve as follows:
1. That an increase for additional consultant fees i
amount of $15,000 is hereby approved.
2. That an amendment between the City of Carlsbad and
Darrell E. Waters for Construction Administration Services, z
of which is attached as EXHIBIT IlAlI and incorporated here
reference is hereby approved.
3. The Mayor of the City of Carlsbad is hereby authorize
directed to execute said agreement for and on behalf of thc
of Carlsbad.

AMENDMENT TO AGREEMENT FOR
ENGINEERING SERVICES
AMENDMENT NO. 1
This Amendment to the Agreement between the parties datec
February 1, 1989 is made and entered into as of the /? IsT
day of A~AGU~T , 1989.
The parties agree that paragraph 4 of the Agreement is amendec
to read as follows:
4. PAYMENT OF FEES
The total fee payable including this Amendment shall no1
exceed $25,000. Payments shall be made per Paragraph 3 of thc
original agreement and as shown on Exhibit rfA1r attached hereto an(
made a part hereof.
Except as provided herein, no other compensation for service:
shall be allowed except for items approved by supplementa
agreements executed pursuant to Paragraph 3.
This amendment shall be effective on and from the day and yea
first above written.

CONSULTANT COMPENSATION
a. Under the general direction of the Municipal Projel
Department and subject to the provisions of Section
of this agreement, the City shall compensate Consulti
for construction administration services in accordar
with the terms, conditions, and services as set fol
herein. The hourly rate for the Consultant shall
$115.00 per hour to include travel time to and fr
required meetings. Additionally, if required a
authorized in advance by City, Consultant shall provi
a Scheduling Engineer at the rate of $62.50 per hour wh
required to support Consultant's services. Sa

It is' understood by the parties to this agreement thal
the aforementioned hourly rate shall be considered to bt
the compensated rate for the duration of the project.
