facie speed limit upon Carlsbad Boulevard from the north boundary of the City to a
point 1,400 feet south of the southerly boundary of the right-of-way of Manzano Drive
and to designate a 50 mile per hour prima facie speed limit upon Carlsbad Boulevard
from 1,400 feet south of the southerly boundary of the right-of-way of Manzano Drive
to the south boundary of the City.
r1 EM EXPLANATION:
At the April 18, 1989 City Council meeting, staff was directed to invest";,.'Ate
establishing a prima facie speed limit upon Carlsbad Boulevard in the northbound
curved segment located under Palomar Airport Road. Subsequent research found that
Ordinance No. 3115 adopted by the City Council on October 16, 1979, established a
35 mile per hour prima facie speed limit for both directions on Carlsbad Boulevard
from the north City limits to a point 1,000 feet south of Manzano Drive. The subject
segment of Carlsbad Boulevard is included within the designated limit established by
Ordinance No. 3115. Also established by Ordinance No. 3115 was a prima facie speed
limit of 45 miles per hour upon Carlsbad Boulevard from 1,000 feet south of Manzano
Drive to the south boundary of the City of Carlsbad. however, this segment of
roadway has been posted at 55 miles per hour for a number of years.
Staff conducted a new engineering and traffic survey on Carlsbad Boulevard southerly
of Manzano Drive with the purpose of evaluating the prima facie speed limits
established by Ordinance No. 3115. The California Vehicle Code requires that a
roadway on which radar is used for speed enforcement must have the prima facie speed
limit justified by an engineering and traffic survey conducted within the last five years.
Results of the recent survey were presented to the Traffic Safety Commission on August
7, 1989.
Upon consideration of all factors of the survey the Traffic Safety ommission agreed,
by a 4 - 0 vote, with the Traffic Safety Coordinating Committee recommendation that
the existing 35 mile per hour speed zone on Carlsbad Boulevard should be extended
southerly an additional 400 feet. The existing 45 mile per hour prima facia speed limit
was not supported by the results of the traffic and engineering survey and could not
be justified. The Traffic Safety Coordinating Committee recommended to the
Commission to establish a 50 mile per hour prima facie speed limit on the remaining
southerly segment of Carlsbad Boulevard. By a 4-0 vote, the Traffic Safety Commission
concurred and recommended raising the prima facia speed limit upon Carlsbad
Boulevard to 50 miles per hour from a point 1,400 southerly of Manzano Drive to the
south City boundary.

FISCAL IMPACT:
Installation of eight speed limit signs on 10-foot posts will cost approximately
$1,000.00.

AN ORDINANCE OF THE CITY COUNCIL OF THE, CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44 OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 10.44.030 TO EXTEND THE
EXISTING 35 MILE PER HOUR PRIMA FACIE SPEED LIMIT
UPON CARLSBAD BOULDEVARD FROM THE NORTH
BOUNDARY OF THE CITY TO A POINT 1,400 FEET SOUTH
OF THE SOUTHERLY BOUNDARY OF THE RIGHT-OF-WAY OF
MANZANO DRIVE AND TO DESIGNATE A 50 MILE PER HOUR
PRIMA FACIE SPEED LIMIT UPON CARLSBAD BOULEVARD
FROM 1,400 FEET SOUTH OF THE SOUTHERLY BOUNDARY
OF THE RIGHT-OF-WAY OF MANZANO DRIVE TO THE
SOUTH BOUNDARY OF THE CITY
The City Council of the City of Carlsbad, California hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is
amended by the amendment of Section 10.44.030 to read as follows:
"10.44.030 Carlsbad Boulevard. (a) Upon Carlsbad Boulevard between
the north boundary of the City and 1,400 feet south of the southerly
boundary of the right-of-way of Manzano Drive the prima facie speed limit
shall be thirty-five miles per hour.
(b) Upon Carlsbad Boulevard between 1,400 feet south of the
southerly boundary of the right-of-way of Manzano Drive and the south
boundary of the City, the prima facie speed limit shall be fifty miles per
hour."
EFFECTIVE DATE: This ordhiance shall be effective thirty days after its adoption
and the City Clerk, City of Carlsbad shall certify to the adoption of this ordinance and

l cause it to be published at least once in the Carlsbad Joumal within fifteen (15) days
2 after its adoption.
