RECOMMENDED ACTION:
Approve Resolution No. 89-Jf)L( , which will change the fee for a copy of
a police report from $7.50 per report plus $1.00 Per page to a flat $10.00
fee.
ITEM EXPLANATION:
In May, 1989, the City Council adopted revised fees for City services.
Included in this package was an increase in the fee for a copy of a police
report. The new fee required a $7.50 charge per report plus an additional
$1.00 per page.
The Police Department has found that t~e administration of the variable
part of this fee has been very awkward, since insurance companies \-Jho
request these reports tend to issue a request for the report plus a flat
fee check at the same time.
Si nee the average report is three pages 1 ong, the Police Department
request that the fee be changed to a flat fee of $10.00 per report. The
Finance Department concurs with this request.
FISCAL IMPACT:
The effect of making the police report fee a flat $10.00 will be minimal
but will increase the efficiency of th~ Police Department.
EXHIBITS:

The attached memo (with attachment) dated September 25, 1989 from
the Police Chief, provides the additional information requested by the

RESOLUTION NO. 89-324
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
REVISING THE FEE FOR POLICE REPORTS
WHEREAS, the City Council of the City of Carlsbad, California, has
6 the authority to establish and revise fees for City services; and
7 WHEREAS, the Pol ice Department has found it difficult and time-
8 consuming to administer a fee for police reports that \aries by the number
9 of pages in the report; and
10 WHEREAS, a flat fee in lieu of the variable fee should cover costs
11 adequately and be easier to administer under the circumstances.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
13 Carlsbad, California, as follows:

1. That the above recitations are true and correct.
2. That the fee for a copy of a police report shall be changed from
16 $7.50 plus $1.00 per page to a flat fee of $10.00 per reports, effect1ve
17 immediately; and

3. That victims of crimes shall be exempt from pay1ng this fee.

REPORT FEES
In order to administer the new rc;:iort fee of $10 we would post a notice at
our reception counter, where all requests for reports are taken. The notice
would exclude victims of crimes. Victims are defined by our reporting
procedures by the nature of the report. For example, all crime and arrest
report forms have specific sections for listing victim, suspect, witness and
reporting party.
If the report can lawfully be released, the person listed as the victim in the
report would be entitled to a copy free of charge. All others would be
required to pay the fee.
We currently have a department directive that basically lists the fees for
services; it does not define exceptions. This directive would have to be
revised to include the victim exclusion. We could also prepare a press
release indicating that we are not going to charge victims for reports. The
only· pact would be the reduced revenue.
