ESTABLISH A NO PARKING ZONE
RECOMMENDED ACTION:
Introduce Ordinance No. d5- amending the Carlsbad Municipal Code to
designate NO PARKING on the easterly side of Pontiac Drive from Tamarack Avenue
to Victoria Avenue and on the westerly side from Tamarack Avenue to a point 140 feet
southerly of Victoria Avenue.
ITEM EXPLANATION:
At the time CT 84-14 and CT 84-35 received Planning Commission approval, the
Conditions of Approval for each subdivision required that Pontiac Drive be posted for
NO PARKING between Tamarack Avenue and Victoria Avenue. As construction of these
subdivisions is now being finalized, the construction "punchlist" has noted the NO
PARKING signs as one of the outstanding items to be completed.
This matter was discussed by the Traffic Safety Commission (TSC) at their September
11, 1989 meeting. By a 3-0 vote, the Traffic Safety Commission recommended that the
NO PARKING zone be established by Ordinance. However, due to the existence of two
homes on the westerly side of Pontiac Drive southerly of Victoria Avenue the
Commission recommended that the NO PARKING zone begin approximately 140 feet
southerly of Victoria Avenue so as not to remove on-street parking from in front of the
two residences. Northerly of Victoria Avenue parking is allowed on both sides of
Pontiac Drive.
FISCAL IMPACT:
No impact as the developer has paid for the NO PARKING signs.

AN ORDINANCE OF THE CITY OF CARLSBAD, CALIFORNIA
AMENDING TITLE 10, CHAPTER 10.40 OF THE CARLSBAD
MUNICIPAL CODE BY THE ADDITION OF SECTION 10.40.074
TO DECLARE A "NO PARKING" ZONE ON THE EASTERLY
SIDE OF PONTIAC DRNE FROM TAMARACK AVENUE TO
VICTORIA AVENUE AND ON THE WESTERLY SIDE OF
PONTIAC DRIVE FROM TAMARACK AVENUE TO A POINT
140 FEET SOUTH OF THE SOUTHERLY BOUNDARY OF THE
RIGHT-OF-WAY OF VICTORIA AVENUE.
The City Council of the City of Carlsbad, California hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code i:
amended by the addition of Section 10.40.074 to read as follows:
"10.40.074 Parking Restricted on Pontiac Drive. There will be
no parking on the easterly side of Pontiac Drive from Tamarack
Avenue to Victoria Avenue and on the westerly side of Pontiac
Drive from Tamarack Avenue to a point 140 feet south of the
southerly boundary of the right of way of Victoria Avenue."
EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoptior
and the City Clerk shall certify to the adoption of this ordinance and

cause it to be published at least once in the Carlsbad Journal within fifteen (15) day
of its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the City Council held th
3rd day of October , 1989 and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad Cit
Council held on the 10th day of October , 1989 by the following vote, to wit:
