O£J> itJfttfC-6_ ^S~?..5 ITEM EXPLANATION; City Council requested that staff review the recently adopted Special Events Ordinance to determine if there is a way that organizations could hold special events within the City of Carlsbad without paying the nonrefundable processing fees which can total up to $500 per event. Staff has reviewed the provisions of the Special Events Ordinance and has found that the most significant portions of the ordinance are the provisions providing for the efficient and safe management of special events, which protect both the City and its citizens. It is felt the Special Events Ordinance provides the necessary management procedures to oversee events as they will change in number and complexity well into the future. The filing fee provisions for the special events have also been reviewed. The fees consist of a minimum of $25, with a sliding scale to $500, based on the street classification and number of intersections impacted by the event. If City Council desires to eliminate the sliding fee schedule for organizations that apply for special event permits, staff would recommend that Section 8.17.050 be amended to include an exemption from all but the $25 filing fee. Cost recovery for actual City resources required to stage the event will continue. Attached is a listing of those special events which have either been held this year, or have been scheduled for this year. The ordinance on special events was adopted in May of this year. This listing gives an overview of the nature of the special events being scheduled in the City of Carlsbad and the fees collected. If City Council chooses to eliminate the sliding scale application fee, the City could expect a loss in revenue of approximately $1500 to $2000 annually based on the current listing of organizations seeking special events. The City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That Title 8, Chapter 8.17 of the Carlsbad Municipal Code is amended by the amendment of Section 8.17.050(c) to read as follows: 11 (c) Applications for a special event permit shall be accompanied by a non-refundable processing fee of $25." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption.
