ITEM EXPLANATION:
Mr. John Barr has requested an Above Ground Encroachment Permit to allow
construction of a gated fence and a portion of an existing pilaster and block wall
within a 20 foot wide drainage easement. Staff has reviewed the request and inspected
the site and determined that the encroachment could be supported. The proposed fence
must be relocated to the edge of the easement and the proposed gate system shall have
two 6' swinging gates with Utilities and Maintenance approved lock. The easement is
needed for access and maintenance of the concrete lined brow ditch, the sewer
manhole and the storm drain manhole.

DEAR LADIES AND GENTLEMEN,
ON 9/19/88 I PURCHASED A NEW HOME AT 2210 SARA WAY,
CARLSBAD. AT THE TIME THE PROPERTY WAS COMPLETELY ENCLOSED
WITH A 5 FT WOOD FENCE. IN NOVEMBER OF 1988 I BUILT A
PILASTER AND BLOCK WALL ON THE NORTH AND SOUTH SIDES OF THE
PROPERTY REPLACING THE ORIGINAL WOOD WALL.
AFTER COMPLETING THE NORTHERN WALL IN THE EXACT LOCATION OF
THE ORIGINAL WALL I LEARNED THAT THE WEST WALL IS
ENCROACHING ON A CITY EASEMENT BY 5 FT.
I AM THEREFORE REQUESTING THE CITY TO GRANT ME AN
ENCROACHMENT EASEMENT PERMIT OF 5 FT LEAVING A 15 FT
EASEMENT AREA.
I PLAN TO BUILD A REPIOVABLE FENCE AT THE NORTHERN AND
SOUTHERN END OF THE PROPERTY LEAVING THE ENTIRE EASEMENT
OPEN TO 20 FT IN THE EVENT THE CITY EVER NEEDS ACCESS TO
THIS AREA. ENCLOSED IS A PROPOSED PLAN AND PICTURES FOR YOUR
REFERENCE.
YOUR COOPERATION IN GRANTING ME THIS REQUEST AND GUIDANCE IN
COMPLETING THIS PROJECT WILL BE SINCERELY APPRECIATED.

RESOLUTION NO. 8 9 - 4 14
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD CALIFORNIA APPROVING THE ABOVE GROUND
ENCROACHMENT FOR 2210 SARA WAY.
WHEREAS, Mr. John Barr has submitted a request to allow a 5 foot portion of ax
existing pilaster and block wall and a gated fence encroachment within the Drainagf
Easement along the north and south sides of his property at 2210 Sara Way; and
WHEREAS, Utilities and Maintenance has determined that the encroachment of i
gated fence would not interfere with the City's ability to use the Drainage Easement tc
maintain and access an existing concrete lined brow ditch, a sewer manhole and a stom
drain manhole;
NOW, THEREFORE, be it resolved by the City Council of the City of Carlsbad
California, as follows:

Council held on the 5th day of December, 1989 by the following vote, to wit:
