ITEM EXPLANATION: Backqround - On June 6, 1989, the City Council adopted by reference a County Medical Waste Ordinance regulating the storage and disposal of medical waste at the request of the County Health Officer. On July 5 1989, the County amended this ordinance by the addition of the sectio listed below. The County made several minor typographical correction which are also listed below. The City has been requested to amend ou and incorporate the additions and corrections as indicated in the Cou Medical Waste Ordinance. Ordinance No.jh-jW, is attached as Exhibit and contains all of the additions and corrections. Additions: 68.1201 (i) DEFINITION OF PUTRESCIBLE HAZARDOUS 68.1203 (a), (b), (c) BIOHAZARDOUS WASTES-SMALI Corrections: 68.1205 (a), (b) SHARPS CONTAINERS & RED BAGS- GENERATORS ADDITIONAL REQUIREMENTS 68.504 (a), (b) HAZARDOUS & MEDICAL WASTES The County established a fee of $105 for generators of less than 220 per month of biohazardous medical waste. This will regulate busines: generate less than 220 pounds per month, in the same manner as those generating more than 220 pounds per month, as currently regulated by County Health Officer. The City of Carlsbad has been requested to a this ordinance, for enforcement by the County Health Officer, of thi requirement. Resolution NO.@+^% attached as Exhibit #2, will est a $105 annual fee for generators of less than 220 pounds per month o biohazardous medical waste. Notice to the Public - The County of San Diego Hazardous Materials Management Division of Environmental Health Services has made multip attempts to notify the businesses that will be affected by the Count Medical Waste Ordinance. Sec. 68.1202 MEDICAL SOT.TD WASTES Any person who is a generator, or an employee of a generator of medical solid wastes, shall store such was. prior to disposal in an area secured as to deny access 1 unauthorized persons, animals, wind, rain, insect,s, and rodents. If such wastes are placed in a trash receptac. or compactor which is accessible at any time to unautho: persons, such receptacle or compactor shall be locked ti prevent access to the contents thereof to anyone other 1 authorized persons or refuse collection personnel. Sec. 68.1203 BIOHAZARDOUS WASTES - SMALL GENERATORS I (a) It shall be itnlawful for any generator of Biohazardous I Wastes who produces less than 220 pounds of such waste t per month to store or dispose of such wastes without an annual permit therefor from the Deputy Director of Environmental- Health Services. Any person desiring a permit required by this chapter SI I make application therefor as prescribed in Title 6, Div t I , 1 [b) ! I 5, section 65.107 of this code. . (c} Any person who is a generator, or an employee of a generator, of Biohazardous Wastes, and produces less th, 220 pounds of such waste per month, shall store and dis] of such waste in the manner provided for in sections 6684O(f), 6684O(g), 6684O(h) , and 66845{a)-(c) of Title of the California Code of Regulations, and shall mainta on the premises a copy af the currant biomedical waste management plan, and documentation verifying the manner I disposal used. Unless approved by the Deputy pirector ( I Environmental Health Services, putrescible bidhazardous waste shall not be maintained by the generator for mure seven days. Non-putrescible biohazardous waste (includ sharps) shall not be maintained by the generator €or mo than six months. The sections of Title 22 of the Calif Code of Regulations specified in this section are hereby incorporated into and made a part of the San Diego County Code. Sec. 68.1204 BIOHAZARDOUS WASTES - LARGE GENERATORS Any person who is a generator, or an employee of a generator, of biohazardous wastes, and produces 220 pounds or more of such wastes per month, shall store and dispose of such waste in the manner provided for fn sectian 66840ta)- (m), 66845(a)-(c), 66850(a)-(h), 66855(a)-(d), 66860, and . 66865 of Title 22 af the California Code of Regulations, and shall maintain on the premises a copy of the current biomedical waste management plan, and documentation verifying the manner of disposal used. Title 22 of the California Code of Regulations specified in this section are hereby incorporated into and made a part of the San Diego County Code. Not less than three copies of the specieied sections are on file in the affica of the Clerk of the Board of Supervisors of the County of San Diego as documents numbered 716514, 716514'(A), and 716514 (B) . L The sections of a S@C. 68,1205 SHARPS CONTAINERS AND RED BAGS - ADDITIONAL REQUIREMENTS In addition to the requirements of Sections 68.1203 and 68.1204, all generators of biohazardous wastes shall meet the following requj ramants: (a) All sharps containers and red bags used in complying with sections 68.1203 and 68.1204 shall be of the type defined in saction 6$.12nl(cI) and (e). fb) All sharps containers and red bags shall be labeled in accordance with Section 68.1201(d) and (e) prior to placing any materials in said containers or bags. When wastes are to be processed in an autoclave prior to disposal by the generator they may be placed in a single red bag which must be placed in a clear auto- clave bag which is labelled in the same manner as required for red bags in Section 68.1201(e). More than one red bag may be placed in an autoclave bag.- Wastes Which are not processed in an autoclave prior to disposal by the generator shall be stored and disposed of in a red bag vhich is sealed inside of a second red bag. {e) Needles and syringes shall not be clipped prior to disposal. I (9) A11 materials disposed of in sharps containers sha be managed in the manner prescribed for biohazard0 wastes in Section 68.1203 whether or not the mater are actually biohazardous wastes as defined in sec 68.1201 (b) . -1 f Sec. 68.1206 MANAGEMENT PUN-PREPARATION AND FILING I ' (a) All. generators of biomedical wastes shall prepare Biomedical Waste Management Plan as defined in section 68.1201(h). The Plan shall be filed with the Deputy Director of Environmental Health Services, and a copy shall be kept at all times on the prmnises af the facility in whi.ch biomedical wastes are being generated. updated and re-filed annually, or when any of whichever occurs first. I (b) Every Biomedical Waste Management Plan shall be I the information contained therein has changed, i Sec. 68.1207 EXEMPTION Sections 68.1201-68.1206 shall not be applicable to biomedical wastes produced by individuals through of through residential service as defined in Section 68.501(h) (30)- of this code. Sec. 6s. 1208 CRIMINAL PENALTY Violation of any of the provisions of this chaptrr shal be a misdemeanor punishable by imprisonment in the coun jail not exceeding one year, or a fine not exceeding te thousarid dollars ($LO,OOO), or both. Any person who violates any of the provisions of this Chapter shall be liable for a civil penalty not to exceed fifteen thousand dollars ($is,ooo) for each such violation. Sec. 68.1211 ENFORCEMENT The Deputy Director of the Environmental Health Senrices Division of the Department of Health Services shall be responsible for enforcing the provisions of this chapter. The Environmental. Health Services division of the agency. Section 2. Subsection (16) of subdivision 6 of Section .. Department of Health Services shall be the administering 68.503. of the County Code of Regulatory Ordinances is amended to read as follows: (16) "Medical Waste" is Biomedical waste, which is defined and regulated according to Chapter 12 of this Division (commencing with Section 68.1201). Section 3. Section 68.504 of the County Code of Regulator Ordinances is amended to read as follows: 'Sec. 68.504, HAZARDOUS AND MEDICAL WASTES {a) No person shall transport or collect hazardous - wastes without compliance with applicable state law. In May 1989, the Hazardous Materials Management Division (H distributed the enclosed llConcerned Party" letter and the ger requirement handout to over 9000 people. The mailing list obtained from the California Department of Consumer Affairs (( and consisted of all licensed physicians, dentists, veterinar: and hygienists located within San Diego County. The HMMD has also provided informational presentations to vai organizations including the Medical, Dental, and Veteri Societies, the North County Surgical Clinic, the Vista Chai-nbl Commerce, the Association for Practitioners of Infection Con and several other organizations which requested information. HMMD has provided 17 presentations to date with several scheduled in the coming months. In addition to the presentations and mailings, the HMMD has over 2500 telephone calls providing one-on-one informatic interested parties. In August, the HMMD began to mail permit applications Biomedical Waste Management Plans to people in those cities wk adopted the Ordinance. Samples of these two documents are enclosed for your review. The CDCA list indicated 193 lic practitioners located in Carlsbad. In response to this problem the B of Supervisors passed County Ordinance 7556-Storage and Disp of Medical Waste, which will be effective on July 21, 1989. Hazardous Materials Management Division (HMMD) of the Co Department of Health Services has been appointed to implement new law. Your facility or practice may be impacted by ordinance. The ordinance defines biomedical waste as biohazardous waste medical solid waste. Biohazardous waste includes laboratory wa fluid blood elements and regulated body fluids, sharps (syrin slides, lancets), contaminated animal carcasses, labora specimens, and- sUrgi-calypecimens Medic-a1 solid waste incl empty specimen containers, bandages, dressings containing liquid blood, surgical gloves, and decontaminated biohazar waste. The ordinance requires generators of biomedical waste, regard of quantity, to store all medical solid waste in a secured t receptacle or locked storage area before final disposal, biohazardous waste, including sharps, must be stored in appr containers labeled with the name and address of the genera Biohazardous waste must be decontaminated before disposal in secured trash receptacle or hauled off-site for treatment t State licensed infectious waste transporter. Biomedical waste does include hazardous waste (as defined in California Health and Sa Code, Section 25117 and California Code of Regulations Title Articles 9 or 11) or radioactive waste (as defined in Califo Health and Safety Code Section 25850(e)). BIOHAZARDOUS WASTE means any of the following: 1) Laboratory waste, including specimen cultures medical and pathological laboratories, cultures stocks of infectious agents from research and indust laboratories, wastes from the production of biolog agents, discarded live and attenuated vaccines, culture dishes and devices used to transfer, inoa and mix cultures or material which may contain infect agents and may pose a substantial threat to health. non-sterilized cultures shall be presumed to biohazardous. 2) Any specimens sent to a laboratory for microbial analysis shall be presumed to be biohazardous. 3) Surgical specimens including human or animal part tissues removed surgically or by autopsy shal presumed to be biohazardous. 4) Recognizable fluid blood elements and regulated fluids, and containers and articles contaminated blood elements or regulated body fluids that re( separate from the solid portion of the waste 1 ambient temperature and pressure. MEDICAL SOLID WASTE shall include, but not be limited to, waste such as empty specimen containers, bandages or dreSsings containing non-liquid blood, surgical gloves, treated biohazardous waste, and other materials which are not biohazardous. SHARPS CONTAINER8 are : Leakproof, rigid, puncture-resistant containers which when sealed cannot be reopened without great difficulty. These containers must be labeled either Ifbiohazardtf or Ifinfectious waste". These containers must be labeled so that the producer's name, address and phone number are visible for inspection. Needles and syringes shall not be clipped prior to disposal. All sharps containers must be managed as biohazardous waste. BIOHAZARDOUS WASTE SIGN is: In English, "C~UT%ON-BIQWAZARBOUS WASTE STORAGE AREA - UNAUTHORIZED PERSONS KEEP OUTfl, and in Spanish, WUIDADO - ZONA DE RESIDUOUS (INFECTADOS) PROHIBPDA LA ENTRADA A PERSONAS NO AUTORIZADWWO. Warning signs shall be readily legible during daylight from a distance of at least 25 feet. BIOHAZARD BAG means double disposable plastic bags which are impervious to moisture and have a strength sufficient to preclude ripping, tearing or bursting under normal conditions of usage and handling sf the waste-filled bags. Each bag shall be constructed of material of sufficient single thickness strength to pass the 165-gram dropped dart impact resistance test as prescribed by Standard D 1709-75 of the American Society for Testing and Materials and certified by the bag manufacturer. The bags shall be securely tied so as to prevent leakage or expulsion of solid or liquid wastes during storage, handling or transport. The bags shall be red in color and conspicuously labeled with the international biohazard symbol and the word ItBiohazardf1. The bags shall be labeled so that the producer9s name, address and phone number are visible for inspection. If the waste is to be autoclaved, the outer bag may be colorless as long as the inner bag is red and both bags meet the stated strength criteria. All biohazard bags must be managed a5 biohazardous waste. PERMITTED BIOHAZARDOUS WASTE HAULER is a hauler who has received a permit from the appropriate agency to haul biohazardous waste. SOLID WASTE HAULER is a hauler licensed by the appropriate agency to haul solid waste (non-hazardous general trash) to the municipal landfill. SS: jw WPB/BIOMED.
