CT 89-19/SDP 89-7/ZC 89-6/HDP 89-37 EIR 89-1 ADOPT Resolution No. 4fl-kh-, APPROVING an amendment to the agreement with Cotton/Beland Associates, Inc., for consulting services to prepare the Environmental Impact Report for the Broccato at Batiquitos Shores project, and to the agreements with Odmark and Thelan and the Davidson Companies Partnership for the provision of funding for said Environmental Impact Report. ITEM EXPLANATION On October 2, 1989, a contract with Cotton/Beland Associates, Inc., in the amount of $23,575, was executed by the City Manager for the preparation of an Environmental Impact Report for the Broccato at Batiquitos Shores project. During the preparation of the Draft Environmental Impact Report for this project additional expenses were incurred by the consultant in an effort to resolve site grading issues and to process two screen checks of the document. In that this additional work was not covered under the original project scope of work and contract, an additional $2,348 is needed to complete said Environmental Impact Report, bringing the total amount of the contract for preparation of the Environmental Impact Report for the Broccato at Batiquitos Shores project to $25,923. I FISCAL IMPACT The developers, Odmark and Thelan and the Davidson Companies Partnership, are responsible for the provision of the funding for the amended Environmental Impact Report. Funds will be deposited with the City in a trust account, upon approval of this amended agreement. EXHIBITS 1. City Council Resolution No. %-65 2. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That certain agreements between the City of Carlsbad and Cotton/Beland Associates, Inc, and the City of Carlsbad and Odmark and Thelan and the Davidson Companies Partnership for consulting services to prepare the Environmental Impact Refiort for the Broccato at Batiquitos Shores Project, copies of which are on file in the office of the City Clerk, and incorporated herein by reference, are hereby approved. 2. The Mayor of the City of Carlsbad is hereby ~ authorized and directed to execute said agreements for and on ,behalf of the City of Carlsbad. AMENDED AGREEMENT FOR CONSULTANT SERVICES TO PREPARE THE ENVIRONMENTAL IMPACT REPORT FOR THE BROCCATO AT BATIQUITOS SHORES PROJECT THIS AGREEMENT, made and entered into as of the A-day of 5iL-L I 1990, by and between the CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as tlCity,ll and ODMARK AND THELAN AND THE DAVIDSON COMPANIES PARTNERSHIP, hereinafter referred to as t@Applicantlt, shall serve to amend the previous contract dated October 2, 1989, on file in the City Clerk's Office. All provisions of the original contract shall remain in effect, and shall be amended as outlined in the revised proposal, dated February 2, 1990, attached hereto, except that Section 4 shall be amended by the addition of $2,348.00 to the contract amount. Section 4 shall read: "The maximum fees payable under this contract are $25,923.00. IN WITNESS WHEREOF we have hereunto set our hands and seals. These expenses require us to request an amendment to our contract with you in order to cover those additional costs which were not included in our original scope of work and budget. This letter serves as an amendment to the contract between Cotton/ Beland/Associates, Inc. (CBA) and the City of Carlsbad (CITY). This amendment authorizes CBA to perform additional work completed to date on the Draft EIR for Broccato at Batiquitos Shores.
