RECOMMENDED ACTION:
Adopt Resolution No.- ?o-'?$ approving plans and specifications and authorizing the City Clerk to advertise for bids for the construction of Alga Road and Poinsettia Lane improvements, Project No. 3305.
ITEM EXPLANATION:
On December 6, 1988, Council initiated proceedings for a 1913/1915 Act special assessment district for the purpose of constructing portions of Poinsettia Lane and Alga Road improvements. On January 16, 1990, Council approved an Acquisition/Financing Agreement with the developer. Under this agreement, the developer will perform the grading and install drainage, underground utilities and a portion of the surface improvements. Upon completion, the City will award a contract to install the surface improvements, including pavement, curb and gutter, sidewalks, streetlights, median and landscaping. The developer has nearly completed its work and will be completed prior to May 15, 1990.
Once a public hearing has been held to confirm the assessment district, bonds will be sold and the funds will be used to pay the developer for its portion of the construction and incidental costs and to pay progress payments to the contractor for the public works contract. As the construction contract will probably be awarded prior to the sale of bonds, the developer will post cash, a letter of credit or other suitable security for the full amount of the construction contract.
The plans, specifications and contract documents for Alga Road and Poinsettia Lane have been completed, checked and approved by the City Engineer. Construction is anticipated to be completed 90 days from Notice to Proceed.
The following is the tentative schedule for this assessment district:
May 15, 1990 Award of Contract - Resolution of Intention June 4, 1990 Start of Construction June 12, 1990 Public Hearing - District Confirmation July 30, 1990 Bond Sale - Delivery of Funds
FISCAL IMPACT:
The total project cost of the assessment district, including right- of-way and financing costs, is estimated to be $20,790,000. Incidental costs, including City staff time, have been paid for by developer deposits which have totaled $268,500 to date. The construction cost for the contract to be awarded is estimated to be $3,080,000. Upon the successful confirmation of the district

and sale of bonds, the developer will be reimbursed for all approved expenditures on the district. The assessments will be passed through to home purchasers but the developer must first obtain Council approval of a disclosure plan.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REFERENCING PREVAILING WAGE SCALE AND DIRECTING CALL FOR CONSTRUCTION BIDS
WHEREAS, the City Council of the City of Carlsbad,
California has heretofore instituted proceedings under the
provisions of the "Municipal Improvement Act of 1913", being
Division 12 of the Streets and Highways Code of the State of
California, for the construction of certain public works of
improvement in a special assessment district known and designated
as:
ASSESSMENT DISTRICT NO. 88-l
(ALGA ROAD)
(hereinafter referred to as the llAssessment Districtl'; and
WHEREAS, at this time there have been submitted for final
review the plans and specifications for the works of improvement
in the Assessment District; and
WHEREAS, it is the intention of this City Council to call
for sealed proposals or bids for the doing of said work and
improvements in said Assessment District: and
WHEREAS, it is necessary to determine the prevailing rate
of wages for the various classifications of workmen required in the
performance of said work,
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the above recitations are true and correct.
2. That the plans and specifications for the works of
improvements in the Assessment District are hereby approved and
authorized for bidding.

SECTION 3. That it is hereby determined and ascertained
that the general prevailing rate of per diem wages in the locality
in which said work described is to be performed in the matter of
the construction of certain public works of improvement, together
with appurtenances, in the Assessment District, under the
provisions of the I'Municipal Improvement Act .of 1913", being
Division 12 of the Streets and Highways Code of the State of
California, for each craft or type of workman or mechanic needed
to execute the contract, and also the general prevailing rate for
legal holiday and overtime work of each craft or type of workman
or mechanic, is in accordance with the schedule obtained from the
Director of Industrial Relations, pursuant to the provisions of
Section 1773 of the Labor Code of the State of California, and
reference is hereby made to copies thereof on file with the
transcript of these proceedings, which said copies are available
to any interested party upon request. Further, a copy shall be
posted at each job site during the course of construction.
SECTION 4. That the proposals or bids shall be opened and
examined at a public meeting so called: and said results of the
bidding shall be reported to the City Council at the next regular
meeting after the opening of bids.
I SECTION 5. That the terms and conditions for bidding on the
works of improvement for this Assessment District are as set forth
in full in the Bid Documents in the Specifications as previously
approved. Reference is hereby made to said Bid Documents
heretofore approved and identified as follows:

For all particulars as to bidding, the Notice Inviting Bids
above referenced and all incorporated documents and laws, including
jut not limited to the "Municipal Improvement Act of 1913l', shall

SECTION 6. That this City Council hereby finds and determines
:hat in the event the Contractor, contracting owners included, does
lot complete the work within the time limit specified in the
:ontract or within such further time as the legislative body shall
uthorize, the Contractor or contracting owners, as the case may
=, shall pay as liquidated damages the amount or amounts as set
:orth in the specifications for the project, said amounts herein
:eferenced and so incorporated. That it is impractical to
letermine the actual damage which will be sustained by reason of
;uch delay, but that the stated sum is a reasonable amount for said
.iguidated damages and is not being imposed as a penalty.
