RECOMMENDED ACTION:

ITEM EXPLANATION:
On March 20, 1990, the City Council adopted Resolution No. 9(
approving a reimbursement agreement with the City of Los Angel Board of Harbor Commissioners, in which the City of Los Ange will fund all costs associated with the continuing environmer
and engineering studies, including the final design, of
Batiquitos Lagoon Enhancement Project. The Council resolution a
included the award of a consultant contract with Moffatt and Nic
Engineers, Incorporated to perform the additional engineering
environmental work.
Because of unusually high water levels, sea bird nesting isla
in Batiquitos Lagoon are currently submerged. Additionally,
least tern nesting season began approximately April 1st with lit
or no nesting areas available in and around the lagoon. The St
of California, Department of Fish and Game recently indicated
the City that they would open Batiquitos Lagoon to the ocean in
near future to allow the lagoon to partially drain ther
uncovering nesting and foraging areas. Thereafter, Fish and G<
opened the lagoon on Monday morning, April 23rd.
After learning of the pending lagoon opening by Fish and Gal Moffatt and Nichol, Port of Los Angeles staff, and City sti unanimously agreed that the opening of the lagoon provided - unique opportunity to have the consultants study the performai of the tidal inlet and, in particular the abundant cobble, dur. tidal cycles. The attached proposed scope of work was prepa: shortly after it was learned that Fish and Game had intended open the lagoon and requires Moffatt and Nichol to provide E field and office support to study the lagoon hydraulics and in1
conditions during the lagoon opening. This information wj
provide data critical to the project’s proposed physical model.
The attached Amendment No. 1 was drafted incorporating the SCC
of work and fee schedule for the additional study. The Port of I
Angeles has approved the additional work and identified all cos
as being the responsibility of the Port as an element of t
project. Please reference the attached letter dated April 17, 19
from the Port of Los Angeles. In accordance with the provisio
of Exhibit B of the six (6) party master Memorandum of Agreeme
for the Batiquitos Lagoon Enhancement Project, the consultant te
was authorized to proceed with the additional field work to monit the lagoon opening.

Because of the timing of the announcement from Fish and Game of th lagoon opening, the necessary preparation of the additional scop of work for Moffatt and Nichol, and the approval from the Port o Los Angeles, it was not possible to schedule the City Council' review and approval of Amendment No. 1 to the Batiquitos Lagoo Enhancement Project's consultant contract earlier than the May 3
1990 Council meeting. Consequently, the Council's review ar approval of this Amendment will occur after the fact. It j
believed that the timing of these events will be an extremely raz
occurrence. Staff recommends approval of the attached Amendmer
No. 1.
FISCAL IMPACT:
The attached Amendment No. 1 identifies all field and office wo'
to be performed by the consultants on a time and materials bas not-to-exceed $35,000. Payment of costs for the study will be ma
directly by the Port of Los Angeles to the consultants as provid for in the payment procedures identified in the mast Carlsbad/Port of Los Angeles agreement.

CITY OF CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. FOR THE BATIQUITOS LAGOON ENHANCEMENT PROJECT

WHEREAS, the City Council of the City of Carlsbl
previously adopted Resolution No. 90-71 approving an agreemer
the Port of Los Angeles, Board of Harbor Commissioners
reimbursement funding for the Batiquitos Lagoon Enhan
Project; and
WHEREAS, said resolution also included the awari
consultant contract to Moffatt and Nichol Engineers, Incorpc
to perform said work; and
WHEREAS, the State of California, Department of F:
Game, has indicated it will open the mouth of Batiquitos Lac
