U&M CITY RECOMMENDED ACTION: AB# ~ 6, ,,: *.'"; - /'i Adopt the attached Resolution 90 -'bLi'$ : - it< LC _-_-._-- 1. Appropriates $285,000 from the General Fund Unappropriated Fund Balance. Directs staff to negotiate the purchase of the rea property located at 2955 Elmwood Street,at a tota price not to exceed $285,000 including relocatic benefits and closing costs. 3. Authorizes the Mayor to execute the purchas agreement only if total costs do not exceed tl- limits established in Recommendation One. 2. 4. Authorizes staff to submit an application for Conditional Use Permit , ITEM EXPLANATION: Upon completion of the new Library, the existing librai building will undergo substantial renovation. Staff h; identified a need to provide additional land for potenti; expansion of the Library during the renovation phase or E a future time. In addition, there is an immediate need t provide additional temporary office space for Library staff Finally, additional space will be required to absorb Cit Hall growth for the next five to ten years or until a ne City Hall is constructed. Accordingly, in May of 1989, staff began a search fc alternatives to provide the additional space requirec Because of the nature of the Library's programs it ws essential that the needed space be immediately adjacent t learned that the single family residence located at 291 Elmwood Street might be available for lease or purchase. TI property is located on the northwest corner of Elmwood Stret and Laguna Drive, just north of the Library. The residenc is tenant occupied. Staff contacted the owner, Mr. James A. Scanlon, to determil the availability of the property and was informed by him th; he would be interested in discussing possible Cil acquisition of the property. Acquisition of property by the City requires a determinatic of General Plan conformity and environmental clearanct Thus, prior to initiating serious discussions with MI Scanlon, staff requested that the Planning Commissic determine whether the City's acquisition of the propert conformed to the General Plan and that the Commission certij the Library, if possible, During the search for space, sta! 0 0 ,IS - PAGE 2 OF AB# /c jj d ,- 2 the Planning Director's environmental determination. On Jul 6, 1989 the Planning Commission determined that tl acquisition of the property conformed to the General Pli and certified the Planning Director's Negative Declaration In addition, should the City Council approve acquisition ( the property, a Conditional Use Permit would be required t permit the City to use the residentially zoned property fc city office purposes. Staff then retained Mr. Donald Yerkes ASA, of Carlsbad t appraise the property and estimate the value. Using a dat of value of October 26,1989, Mr. Yerkes estimated the fai market value of the property to be $265,000. Mr. Scanlc also obtained an appraiser, Mr. Art Ammon of Carlsbad, wk estimated the fair market value of the property, as c October 25, 1989, to be $271,500, or 2.5% higher than tl- City appraisal. Since completion of the appraisals, staff has had severa discussions with Mr. Scanlon regarding acquisition of th property, the purchase price and relocation benefits. It no appears that Mr. Scanlon is ready to entertain an offer o $271,500, the value established by his appraiser, plu appraisal and legal expenses estimated not to exceed $1,500 Expenses to relocate the tenant, as required by State law are estimated to be $6,500 or less. Closing costs should no exceed $4,000. A purchase price of $271,500 plus expenses, as requested b Mr. Scanlon appears to reasonable, especially in view of th time that has elapsed since the date of value. Therefore, staff recommends that the City Council authoriz negotiations to complete the acquisition ofthe real propert located at 2955 Elmwood Street: authorize the Mayor t execute the purchase agreement if total acquisition cost doe not exceed $285,000; appropriate sufficient funds from th General Fund Unappropriated Fund Balance to fund th acquisition and authorize staff to apply for a Conditiona Use Permit. FISCAL IMPACT: Approval of the recommended action could result in th expenditure of up to $285,000 as follows: Real Property at 2955 Elmwood Street $271,500 Property Owner Legal & Appraisal expenses 1,500 6,500 Tenant relocation expenses Closing costs 4,000 TOTAL ACQUISITION COST $283,500 e 0 PAGE 3 OF AB# !L,//G i ‘-- The Council may make funds available for this purchase fro the General Fund Unappropriated Fund Balance.
