ITEM EXPLANATION:
The owners, Robert A. Perkins and Martie Perkins, have offered 9 feet of r
along a portion of the southeasterly right of way of 4030 Park Drive for de
street right of way purposes. The offer was made as a condition of I
building permit in conformance with Chapter 18.40.030 of the Carlsbac
Code.
FISCAL IMPACT:
Requiring dedications as a condition of development will save the City expl
future right-of-way acquisitions.

SUBORDINATION AGREEMENT
NOT1 CE : THIS SUBORDINATION AGREEMENT RESULTS IN YOUR
SECURITY INTEREST IN THE PROPERTY BECOMING SUBJECT TO AN ESTATE IN THE REAL PROPERTY
TO WHICH YOUR SECURITY INSTRUMENT ATTACHES AND HAS THE POTENTIAL EFFECT OF REDUCING THE VALUE OF YOUR SECURITY INTEREST.
THIS AGREEMENT, made this 21st day of March 19% by
A. Perkins, Jr. and Martie Perkins hereinafter referred to as "Owner," c
the land and Homefed Bank, Federal Savings Bank, hereinafter referrec
"Beneficiary"; present owner and holder of the deed of trust here
described;
WITNESSETH
THAT WHEREAS, Robert A. Perkins, Jr. and Martie Perkins did
a deed of trust, January 25, 1990, to Homefed Bank, Federal Savings B
trustee, covering that portion of Lot 1 of Rancho Agua Hedionda Map 823 t
with that portion of Lot 1 of Block "H" of Bellavista Map 2125 Common1
as San Diego Assessor Parcel 207-021-04 to secure a note in the sum
hundred twenty five thousand dollars ($225,000.00) dated January 25, 1
favor of Homefed Bank, Federal Savings Bank recorded in the office of thc
Recorder of San Diego County on February 2, 1990, as File No. 90-06
Official Records of said county; and
WHEREAS, Owner has executed, or is about to execute, as gra
grant of Easement dated March 149 1990 , in favor of the City of Carl

grantee herein referred to as ”Easement Grantee,” creating an Easeme
particularly described in Exhibit A attached hereto; and
WHEREAS, Easement Grantee is willing to accept said E
provided the grant of Easement is a charge upon the above described F
prior and superior to the lien or charge of the deed of trust above me
and provided that beneficiary will specifically and unconditionally subc

of the Easement created in favor of Easement Grantee; ana
WHEREAS, it is to the mutual benefit of the parties here

3. That this agreement shall be the whole and only agreem

mentioned to the Easement in favor of Easement Grantee above referrec

shall supersede and cancel, but only insofar as would affect the F

prior agreement as to such subordination including, but not limited

BENEFICIARY declares, agrees and acknowledges that:
1. He consents to and approved the grant of Easement in 1
the Easement Grantee.
2. He intentionally and unconditionally waives, re1 inqui
subordinates the lien or charge of the deed of trust above mentioned
Easement in favor of Easement Grantee above referred to and understands
re1 iance upon, and in consideration of, this waiver, relinquishml
subordination of the grant of Easement is being executed and deliver
Easement is being created, and that specific monetary and other obligat
being and will be entered into by the Easement Grantee, other lenders at
insurance companies which would not be made or entered into but f
reliance upon the waiver, re1 inquishment and subordination; and
3. An endorsement has been placed upon the note securec

RESOLUTION OF THE BOARD OF DIRECTORS
"The Bank next discussed the designation of signing authoritie
on behalf of the Bank. After discussion, upon motion duly mad and seconded, the following resolution was unanimously passed:
RESOLVED, that any corporate officers, as appointed by th
Board of Directors each year, identified either as member
of the Executive Group, having the functional titles
contained in Exhibit D, attached to these minutes and mad a part hereof by this reference, or as Vice Presidents,
acting individually, shall have the authority to sign,
verify, acknowledge and deliver in the name of and on
behalf of the Bank, any and all documents and instruments
of writing whatever, including instruments of conveyance
property and for the release of obligations to the Bank;
RESOLVED, FURTHER, that any two (2) members of the
Executive Group, acting together, be and they hereby are,
empowered to designate individual(s) who shall have the
authority to sign, verify, acknowledge and deliver in the name of and on behalf of the Bank, any and all documents and instruments of writing whatever, including instrument
of conveyance of property and for the release of obligations to the Bank, and shall file such designatiom
with the office of the Corporate Secretary in the manner prescribed by the Corporate Secretary; and
RESOLVED, FURTHER, that any instrument of conveyance
of property, release of obligation or execution of
evidence of indebtedness wherein the dollar amount
of the transaction equals or exceeds the sum of fifty thousand dollars ($50,000) shall be executed by any two (23 of the officers or designated individuals,
and that on any instrument of writing requiring the
affixation of the seal of the Corporation, any one of the officers or designated individuals, not having
signed the instruments, may, in the absence of the
Secretary, perform the function and attest to the affixation of the seal of the Corporation.ll
