TO AGREEMENT FOR RIGHT-OF-WAY SERVICES FOR THE BATIQUITOS
RECOMMENDED ACTION:
Adopt Resolution No. ~~-/~~ approving Amendment No. 1 to a existing agreement to provide additional right-of-way engineerin services required for the Batiquitos Lagoon Enhancement Project
ITEM EXPLANATION:
The six (6) party master Memorandum of Agreement for tk development of the Batiquitos Lagoon Enhancement Project assigr the responsibility for the acquisition of all required rights-o' way for the Enhancement Project with the City of Carlsbad. t March 7, 1989, the City Council adopted Resolution No. 89-1
approving an agreement with Right-of-way Engineering Service
Incorporated, of Oceanside, California, to provide necessary righ
of-way engineering, land surveying, photogrammetric work, tit
research work, and related preliminary right-of-way analyses f the ultimate Enhancement Project. This firm completed t
preliminary right-of-way work for the project earlier this yea
The attached amendment to the existing consulting agreeme proposes to expand the consultantls scope of work to include:
Provide ongoing right-of-way engineering work for the Batiquit
Lagoon Enhancement Project. Additional tasks are to include t preparation of legal descriptions, exhibit plats, furtl
research of title documents, notations of liens z
encumbrances, and other document preparation required
position the City for the future acquisition of requi
property interests and other rights-of-way.
Provide field surveys necessary to define and map the wetla boundary in and around Batiquitos Lagoon.
Prepare and file with the appropriate governmental agencies authorities a Record of Survey map depicting the wetla boundary in and around Batiquitos Lagoon.
Provide all coordination, supervision of subconsultan attendance at meetings, provide all other research capabiliti etc: p required to accomplish the ongoing right-of- engineering work.
On March 20, 1990, the City Council adopted Resolution No. 9( approving a reimbursement agreement with the City of Los Angel through its Board of Harbor Commissioners, in which the Port of Angeles will reimburse the City of Carlsbad for all City expe
related to the ongoing administration of the Batiquitos La1
Enhancement Project. Further, the agreement provides for the of Los Angeles to directly pay the consultants for all appr
costs and expenses related to the right-of-way engineering p

of the project. It is recommended that the City Council approy
the attached Amendment No. 1 to the existing agreement for right
of-way engineering services for the Batiquitos Lagoon Enhancemer Pro j ect .
FISCAL IMPACT:
The total cost of the additional scope of services for the propost
Amendment No. 1 to the existing right-of-way engineering servicr
agreement is estimated to be $27,800. As indicated above, the Po
of Los Angeles will directly pay the consultant for all wo
related to this phase of the project. Through the existing Po
of Los Angeles/City of Carlsbad reimbursement agreement, the Po will continue to reimburse the City for all City related expens
associated with the administration of the project. These expens are anticipated to be minimal.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AMENDMENT
NO. 1 TO AN EXISTING AGREEMENT FOR ONGOING RIGHT-OF-WAY ENGINEERING SERVICES FOR THE
BATIOUITOS LAGOON ENHANCEMENT PROJECT
WHEREAS, the City Council of the City of Carlsbac
previously entered into a reimbursement agreement with the Ci'
Los Angeles, acting by and through its Board of H
Commissioners, for the reimbursement of ah1 costs associated
the ongoing administration and development of the Batiquitos L
Enhancement Project; and
WHEREAS, the City Council of the City of Carlsba
previously entered into the master Memorandum of Agreement fc
Batiquitos Lagoon Enhancement Project which assigns the Ci
Carlsbad responsibility for the administration and acquisit:
all required project rights-of-way; and
WHEREAS, the City Council of the City of Carlsbi
previously entered into an agreement with Right-of-way Engin
Services, Incorporated, to provide right-of-way engir!
services for said project; and
WHEREAS, the City Council of the City of Carlsbad
finds it necessary, desirable, and in the public interest to
the existing scope of work with the consultants to :
additional right-of-way work required of said project.
