RECOMMENDED ACTION:
Adopt Resolution No. qC-/.!$;$- approving an agreement betwee City of Carlsbad and County of San Diego which would amend t existing animal control contract for fiscal year 1990-91.
ITEM EXPLANATION:
This resolution amends the existing contract between the Cit
Carlsbad and the County of San Diego to extend the contract
provide for animal services for FY 90-91 and to adjust the F for those services. This is a full cost recovery program of
county which is supplemented by revenues derived from fees c for license and non-license programs from citizens of CarlsX
The estimated costs for FY 90-91 are $144,618. Estimated rc
are $59,947. The difference of $84,671 would be the estimai
charges to the City, plus an amount equal to the pro-rata SI
salary increases approved by the Board of Supervisors for f.
year 1990-91. Staff has reviewed the agreement and recommel
approval.
FISCAL IMPACT:
This fiscal impact is $84,671 for contract services.

WHEREAS, The City desires to contract with the County for the perf

CITY ASSISTANCE
2. To facilitate the performance of said functions, it i

RESPONSIBILITY FOR EMPLOYEES
5. City shall not be liable for the direct payment
salaries, wages, or other compensation to any County personnel per
services hereunder for County or any liability other than that provic

Except as herein otherwise specified, the City shall not be

6. County shall defend, indemnify, protect, and hold City
agents, officers and employees harmless from and against any and all

7. This Basic Agreement shall not impose upon the D

with respect to the enforcement of such City ordinances.
TERMINATION CAUSED BY CHAPTER 6
0. Notwithstanding anything to the contrary herein cor
this contract shall be terminated at any time that City fails to enact
maintain in full force and effect, including the amount of fees provi
ordinance identical to, or adopts by reference the provisions of Chi
Division 2, Title 6 of the San Oiego County Code, unless any deviat
specifically agreed to by the County Director of Animal Control (Si
County Animal Control Ordinance No. 7182). This contract shall
terminated if the County requests that the City enact amendments
ordinance to comply with amendments to Chapter 6, Division 2, Title I

San Diego Code adopted by the Board of Supervisors and such amendmen
not made within 120 days of this request.
PAYHEWT OF FUL% COST
9. For and in consideration of animal control services by C
City agrees that it shall pay the full cost to the County of providin
services at rates determined by the County of San Diego and established
Item U11 herein. City further agrees that County may keep and retain a
all license and other fees specified in the Animal Control Servici
Resolution collected by the County pursuant to this agreement, and
agrees to credit such collections against City’s obligation to pay th
cost of animal control services.

The County agrees, through the Department of Animal Cont
provide within 30 days of adoption of this agreement and, on or
January 15th of each year thereafter, an estimate of the total cos
revenue and resulting net charges for all animal control services
provided to the City for the following fiscal year.
BILLIN6 FOR SERVICES
City will be billed four times during the fiscal year: aft
fourth ARMS period, the seventh ARMS period, the tenth ARMS period a
thirteenth ARMS period. An ARMS period is one of the thirteer
intervals, each being four-weeks except for the 1st and 13th in each
year, used by County in its Accounting and Resource Management System 1

period, the County shall provide City an invoice for the amount due.
Should the amount of actual revenues collected exceed the esl

10. This contract shall become effective on the date herei

RESTRICTIONS BY SECTION 23008
All services rendered hereunder are subject to the limitati
the provisions of Section 23008 of the Government Code, and in accc
therewith, before any services are rendered pursuant hereto, an amount
to one-hundred ten percent (110%) the estimated annual net charges st
budgeted by the City from its funds to ensure payment for work, servi

PROVISION FOR INVOICE AND BILLING
13. The County through its Department of Animal Control
render to said City within twenty (20) working days after the close (
billing period an itemized invoice which covers all services performed
said billing period, and said City shall pay County therefore within
(30) days of receipt of the invoice.
If such payments provided above and in Section 9 of this c
are not delivered to the County office which is described on said i

I want to call the council's attention to the fact that thl San Diego County Department of Anirnal Control has recently expanded pound seizure beyond the Bonita pound to include central "shelter:' which for many years has been exempt fr pet sales to UCSD's research labs.
As usual, it is difficult to get definitive information fr Animal Control, so we still do not know whether this expan of pound seizure represents a net increase of pets going t
UCSD, or whether the Palomar Road facility might also be t geted for pet sales under an unannounced yew policy.
Since your'council is already on reccrd by contract addenc
as disapproving pour.:! seizure, this year S.T.O.P. will be
asking that you enact an ordinance prohibiting the sale b)
Animal Control of any pets picked up in this city.
This action has been taken by many cities in Los Angeles
County (including L.A. City) and in hundreds of towns and cities across America where Anirnal Control is provided by
the county.
Unfortunatley, such a move r\r, ~OUL part will not end pounc
seizure in San Diego County but will protect your constiti
ant's pets and will place Carlsbad firmly in the columi of those cities opposed to sending pets to research labs.

ANIMALS FOR RESEARCH PUXPOSES
WKEREAS, the City Council of the City of Santa Ana has been informed that unclaimed stray animals from the City of Santa Ana are often sold for research purposes by the Orange County Animal Shelter; and
of using living animals for research where alternative methods are available.
WHEREAS, this Council is opposed to the practice
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA:

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BUWA PARK
REQUESTING THE COUNTY OF ORANGE TO DISCONTINUE SELLING OR
GIVING AWAY ANIMALS FOR RESEARCH PURPOSES.
WHEREAS, public fear of animals being used in medical experimen
prevents some people from taking pets or strays to the County Animal
Shelter; and
WHEREAS, animals left free to roam add to the pet surplus and
increase the cost of animal control; and
WHEREAS, animal shelters should sene primarily as a sanctuary
for animals and not a source of inexpensive animals for experimentat
and a
WHEREAS, there are many sophisticated methods available for de-
termining the effects of drugs and chemicals on humans without using
animals; and
WHEREAS, animals from many Orange County cities are often sold
research purposes by the Orange County Animal Shelter; and
kHEREAS, the City Council of the City of Buena Park would like
eliminate the practice of selling or giving away animals by the Oran
County Animal Shelter for research.
NOW, THEREFORE, BE IT RESOLVZZ kat the City Council of the Cir
of Buena Park requests all cities in Orange County to encourage the
Animal Shelter not to sell or give away animals to any person or org
ization desiring such animals for research purposes, *
BE IT FURTHER RESOLVED that the City Council urges all cities t
instruct their employees to specify that animals turned in by them t
County Animal Shelter shall not be used for research purposes.
AND BE IT FURTHER RESOLVED that a copy of this Resolution be
forwarded to the Orange County Board of Supervisors and to the Orang

and pay for the required license for such dog for
the current year, unless such a license already is
issued and in full force and effect.
