HomeMy WebLinkAbout1990-06-19; City Council; 10677; Open Space Advisory Committee Recommendation, u ul Cl’- OF CARLSBAD - AGENC- BILL AD HOC BUBCOMMITTEE RECOMMENDATION REGARDING OPEN SPACE ADVISORY COMMITTEE RECOMMENDED ACTION: Adopt Resolution No. qo-,&jb establishing an Open Space Advisory Committee. Adopt Resolution No. 90-l&7 appointing seven members to serve on the Committee. ITEM EXPLANATION One of the recommendations from the Citizens Committee to Study Open Space was to consider the establishment of an Open Space Commission. In order to study this recommendation, the City Council approved the formation of an Ad Hoc Subcommittee consisting of five members from the Open Space Citizens Committee (Nygaard, Round, McBane, Heineman and Wilkinson), three members from the Parks and Recreation Commission (Lawson, Knox and Castner), and three members from the Planning Commission (Hall, Schlehuber and McFadden). The Ad Hoc Subcommittee met on April 30 and May 14, 1990 to discuss the matter. As a result of those discussions, the Subcommittee is recommending that the City Council adopt the attached resolution establishing a seven member Open Space Advisory Committee. The Committee would advise the City as the Council considers implementation of the recommendations contained in the Report of the Citizens Committee to Study Open Space which was accepted by the City Council on September 12, 1989. The Committee would be in existence until all decisions on the recommendations have been made and implemented or three years whichever occurs first. At, or before that time, the City Council would determine whether a permanent Commission is needed. The Ad Hoc Subcommittee recommends that membership of the Committee would consist of five members from the Citizens Committee to Study Open Space appointed by individual Council members and a member from the Planning Commission and the Parks and Recreation Commission appointed by the Mayor and approved by the Council. The resolution incorporates this recommendation. However, state law mandates that appointments in Cities with a directly elected mayor be made by the mayor subject to confirmation by the Council. The City Attorney advises that the Council may not by local action limit the mayor's authority under state law. Therefore, the Council should revise Section 3 of the resolution to provide that committee members shall be appointed by the Mayor with the approval of the Council. Except for the wording in two sections of the proposed resolution, the Ad Hoc Subcommittee approved the proposal unanimously (11-o). Section 7 was recommended by a vote of 9- 2 (McBane, McFadden). Section 8 was recommended by a vote of 9-2 (Hall, Lawson). PAGE 2 OF AGENDA BILL NO. /o/b77 The recommendation of the Ad Hoc Subcommittee is to adopt the resolution creating the Open Space Advisory Committee and to appoint the seven members. FISCAL IMPACT Support for the Committee would be provided by existing staff from the Planning Department with assistance from various department staffs who have already been assigned tasks from the Report of the Citizens Committee to Study Open Space. Maintenance and operation costs are estimated to be $5,000. Funds have been requested in the 1990-91 budget for professional services to assist in implementing the Open Space Citizens Committee recommendations. $5,000 could be transferred from professional services to fund the Advisory Committee. Box 4650 Carlsbad, CA 92008 June 26, 1990 Dear Mayor Lewis and Councilmembers: RE: Ad Hoc Subcommittee Recommendation on Open Space Advisory Committee FUTURE believes that the proposed protocol for tie appoint- ment of an Open Space Advisory Committee will not accomplish the stated objective of "providing community representation to the Planning Commission and City Council on Open Space issue"-including the planned update of the Open Space Element of the General Plan. We believe the goal of community representation for the Open Space Element update would be better served by seeking applications, to include a qualifications statement, from all interested members of the Carlsbad public. We are also concerned about the proposed change in past practice of honoring the preference of individual council members in the selection of citizens committees. This practice has resulted in broader representation on the committees so. selected, such as the 1985 Land Use Review Committee. We therefore ask the Council to open the application process to all Carlsbad residents and to continue its longstanding practice of honoring the requests of individual council members in the selection of citizens committees--especially those reviewing and/or advising the City on any aspect of the General Plan. The following is incorporated with the suggestions of the Ad Hoc Subcommittee Report, and it is my recommendation that the following be appointed: Alan Reece Kip McBane Bud Schlehuber Kim Welshons Homer Hupf Shirley Dahlquist Fay Round Matt Hall Courtney Heineman Open Space Committee Open Space Committee Planning Commission Parks & Recreation Commission Open Space Committee Parks & Recreation Commission Open Space Committee Planning Commission Open Space Committee It is my recommendation that all Committee members serve for a period of three years, and that the sunset clause for the Committee be in effect. It is also recommended that if a member resigns, or a replacement is needed, that said replacement will be selected from the source of the previous member, i.e. Open Space Committee, Planning Commission, or Park & Recreation Commission. WHEREAS, on September 12, 1989 the City Council accepted a report from a 15-member Citizens Committee to Study Carl&ad's Open Space Plans and Programs; and WHEREAS, one of the recommendations of the report was to consider the need for an Open Space Commission: and WHEREAS, the City Council appointed an Ad Hoc Subcommittee to make a recommendation on the establishment of an Open Space Commission: and WHEREAS, after discussing the matter, the Ad Hoc Subcommittee recommended that an interim Open Space Advisory Committee be created. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. An Open Space Advisory Committee of the City of Carlsbad is hereby created. 2. The Purpose of the Open Space Advisory Committee is to advise the City Council, the Planning Commission, the Parks and Recreation Commission, other Commissions, Board and Committees as deemed necessary, and the City staff on the implementation of the recommendations of the Citizens Committee for Open Space accepted by the City Council on December 19, 1989 and on file in the Office of the City Clerk. 3. The Open Space Advisory Committee shall consist of nine members appointed by the Mayor with the consent of the Council. Two members shall be appointed from the Planning Commission and two members shall be appointed from the Parks and Recreation Commission, and five members from the 15-member Citizens Committee to Study Open Space. Vacancies shall be filled in the same manner. The Committee shall meet regularly as often as it deems necessary for the transaction of business. Its meetings shall be open to the public. The Committee shall elect a chairperson and a vice-chairperson from its membership who shall hold office for one year and may establish its own rules and procedures necessary for the conduct of business. Four members shall constitute a quorum. The City Council declares that the public interest, nvenience and welfare required the appointment of an Open Space visory Committee to act in a purely advisory capacity to the ty Council for the purposes enumerated herein. Any power herein legated to Committee to adopt rules and regulations shall not be nstrued as a delegation of legislative authority but purely a legation of administrative authority. 8. This resolution shall remain in effect for three years from the date of its enactment. At any time before the end of the three-year period, the City Council may extend the tenure of the Committee if it decides that implementation of the recommendations of the Citizens Committee on Open Space has not been completed or that there is need for continuous monitoring of Open Space policies and their implementation.
