RECOMMENDED ACTION: Adopt Resolution No. ^-/ff'7' , calling and giving notice of a General Municipal Election to be held on November 6, 1990; Adopt Resolution No. tftf-ffg , requesting the Board of Supervisors to consolidate the election with the statewide election being held that day; and Adopt Resolution No. y^-Xyf, adopting regulations for candidates for elective office at the election. ITEM EXPLANATION In preparation for the General Municipal Election, it is necessary for Council to take certain actions. This agenda bill presents the first three actions required. 1. Calling the Election The attached Resolution No. 30-ltff , calls and gives notice of the General Municipal Election to be held in the City on November 6, 1990. This Resolution addresses the elected offices. If propositions are to be placed on the ballot, subsequent resolutions will be prepared to amend this resolution. The nomination period for candidates is July 16, 1990 to August 10, 1990. If an incumbent does not file, the deadline extends to August 15, 1990. 2. Consolidation with Statewide Election The attached Resolution No. 90-19? , requests the Board of Supervisors to consolidate our General Municipal election with the statewide election being held the same day. This resolution will also be amended if propositions are added to the ballot. 3. Candidate Regulations The attached Resolution No. ^O-W? , adopts regulations for candidates for elective office at the General Municipal Election. These regulations are in accordance with previous elections, as follows: a. Length of Candidate Statement O Section 10012 of the Elections Code provides that candidate statements shall not exceed 200 words unless the City Council authorizes an increase from 200 to 400 words. Consistent with previous elections, this Resolution maintains the 200 word 2 limitation for candidates statements. I Page 2 Agenda Bill I b. Advance Payment of Charges for Printing Candidate Statements Section 1002 of the Elections Code provides that cities may estimate the cost of printing, handling and mailing candidate statements and sample ballots and may require each candidate filing a statement to pay in advance the estimated cost. Following the election, when actual costs are known, candidates can then be billed for underpayment, or refunded for overpayment. Consistent with previous elections, this Resolution does not require payment in advance. To date, all candidates have paid within a reasonable time after receipt of the billing following the election. c. Spanish Translation of Candidates Statements Section 10012 of the Elections Code provides that the Clerk shall provide a Spanish translation of statements for those candidates who request one. Consistent with the previous election, this Resolution requires candidates requesting a Spanish translation to pay the costs, unless Council directs otherwise. That cost is $75. d. Rotation of Candidate Names on the Ballot Section 10217.7 of the Elections Code gives the options to cities to provide for the rotation of candidates names on the ballot. To utilize this option, it would be necessary to designate election precincts into clusters in accordance with the provisions of the Elections Code. The clusters shall be numbered, with the first cluster having candidates names appear on the ballot in the order determined by the Secretary of State's randomized alphabet drawing. Each successive cluster shall then have the names rotated in accordance with the provisions of the Elections Code. Due to the additional printing requirements, boundary realignments, and computer programming, implementation of the candidate name rotation could cost the city an additional $20,000. Once again, this Resolution has been prepared consistent with previous elections, and does not provide for rotation of names. FISCAL IMPACT The cost of the election is estimated at $11,000, but variables which would affect that are number of candidates, addition of propositions, and a significant change in the number of registered voters. Resolution No. 0-y , adopting regulations for candidates. 1 RESOLUTION NO. 90-197 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CALLING AND GIVING NOTICE 3 OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 6, 1990 FOR THE 4 ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF 5 CALIFORNIA RELATING TO GENERAL LAW CITIES. 6 WHEREAS, under the provisions of the laws relating to General Law Cities 7 in the State of California, a General Municipal Election shall be held on 8 November 6, 1990, for the election of Municipal Officers; 9 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DOES 10 HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: 11 SECTION 1. That pursuant to the requirements of the laws of the State of 12 California relating to General Law Cities, there is called and ordered to be 13 held in the City of Carlsbad, California, on Tuesday, November 6, 1990, a 14 General Municipal Election for the purpose of electing a Mayor for the full term 15 of four years; two members of the City Council for the full term of four years; 16 a City Clerk for the full term of four years; and a City Treasurer for the full 17 term of four years. 18 SECTION 2. That the ballots to be used at the election shall be in the 19 form and content as required by law. 20 SECTION 3. That the City Clerk is authorized, instructed and directed to 21 procure and furnish any and all official ballots, notices, printed matter, and 22 all supplies and equipment that may be necessary in order to properly and 23 lawfully conduct the election. 24 SECTION 4. SECTION 5. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 6. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 7. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions. RAUTENKRANZ, City Clerk (SEAL) 1 RESOLUTION NO. 90-198 2 A RESOLUTION REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN DIEGO TO CONSOLIDATE A 3 GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF CARLSBAD ON TUESDAY, NOVEMBER 6, 1990, 4 WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THAT DATE PURSUANT TO SECTION 23302 OF THE 5 ELECTIONS CODE. 6 WHEREAS, the City Council of the City of Carlsbad called a General 7 Municipal Election to be held on November 6, 1990, for the purpose of the 8 election of a Mayor, two Members of the City Council, a City Clerk, and a City 9 Treasurer; and 10 WHEREAS, Section 439.1 of the Administrative Code of the County of San 11 Diego authorizes the Registrar of Voters of the County of San Diego to render 12 specified services relating to the conduct of an election to any City which has 13 by resolution requested the Board of Supervisors to permit the Registrar to 14 render the services, subject to requirements set forth in that section; and 15 WHEREAS, the City of Carlsbad called an election to be held on the same day 16 in the same territory or in territory that is in part the same; 17 WHEREAS, pursuant to Part 2.5 (commencing with §23300), Division 14 of the 18 Elections Code, the Board of Supervisors has authority to consolidate public 19 district, city, county or other political subdivision elections with each other 20 and with a statewide election to be held on the same day; 21 NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above-cited 22 provisions, the Board of Supervisors of the County of San Diego is hereby 23 requested to permit the Registrar of Voters to perform and render all services 24 and proceedings incidental to, and connected with, the conduct of the subject 25 election of the City of Carlsbad, with cooperation and assistance of the City 26 Clerk of the City of Carlsbad, such services to include, but not to be limited 27 to the following activities as are appropriate to the subject election: 28 1 1. Furnish a tabulation of the number of registered voters in each 2 precinct. 3 2. Establish voting precincts, secure locations for polling places, secure 4 the services of election officers for each precinct as required by law, and 5 furnish a list of precincts, polling places and election officers for filing in 6 the office of the City Clerk of the City of Carlsbad. 7 3. Prepare and furnish to the election officers necessary election 8 supplies for the conduct of the election. 9 4. Cause to be printed the requisite number of sample ballots, official 10 ballots, polling place slips, rosters, tally sheets and other necessary forms. 11 5. Furnish and address the envelopes necessary to mail sample ballots to 12 the registered voters of the City of Carlsbad. 15 6. Insert the sample ballots and other printed matter into envelopes for 14 mailing, and cause the same to be mailed, as required by law. 15 7. Assemble the election material and supplies into ballot bags and make 16 necessary arrangements for their delivery to the various precincts. 17 8. Distribute absent voter ballots as required by law. 18 9. Receive the returns of the elections and supplies. 19 10. Sort and assemble the election material and supplies in preparation 20 for the canvassing of the returns of the election. 21 11. Canvass the returns of the elections, including the absent voters 22 ballots. 23 12. Furnish a tabulation of the number of votes given in each precinct. 24 13. Make all arrangements and take the necessary steps to pay the members 25 of the precinct boards, the polling place rentals, the persons returning the 26 ballot bags, and to pay all other costs of the election incurred as the result 27 of services performed for the City of Carlsbad and pay for the election 28 1 officials the amounts prescribed by the Board of Supervisors of the County of 2 San Diego. 3 BE IT FURTHER RESOLVED that pursuant to the requirements of the laws of the 4 State of California relating to General Law Cities within said State, the 5 election of the qualified electors of the City of Carlsbad was called for the 6 purpose of the election of a Mayor, two Council Members, a City Clerk, and a 7 City Treasurer. 8 BE IT FURTHER RESOLVED that the Board of Supervisors of the County of San 9 Diego is hereby requested to consolidate this election with the other elections 10 to be held on the same day, in the same territory, or in territory that is in 11 part the same. 12 BE IT FURTHER RESOLVED that if this consolidation is ordered, then pursuant 13 to Section 23306 of the Elections .Code (a) the election shall be held in all 14 respects as if there were only one election; (b) only one form of ballot shall 15 be used; and (c) the Registrar of Voters of the County of San Diego shall 16 canvass the returns of the subject election as part of the canvass of the 17 returns of the election or elections consolidated hereby. 18 BE IT FURTHER RESOLVED that if this consolidation is ordered, then pursuant 19 to Section 23305 of the Elections Code, within the territories affected by this 20 order of consolidation, the election precincts, polling places, voting booths ^1 and polling hours shall, in every case be the same, and there shall be only one 22 Set of election officers in each of the precincts. 23 BE IT FURTHER RESOLVED that the County of San Diego shall be reimbursed in 24 full for the services performed by the Registrar of Voters for the City of 25 Carlsbad upon presentation of bill therefor. 26 /// 27 /// 28 1 BE IT FURTHER RESOLVED AND ORDERED that the City Clerk of the City of 2 Carlsbad is hereby directed to deliver forthwith certified copies of this 3 resolution to the Clerk of the Board of Supervisors of the County of San Diego 4 and to the Registrar of Voters of the County of San Diego. 5 PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of 6 the City of Carlsbad on the 26th day of June , 1990, by the following 7 vote, to wit: 8 AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson 9 NOES: None 10 ABSENT: None 11 12 13 ATTEST: 14 15 MIT73U z. IN^^U^I/^— 16 ALITHA L RAUTENKRANZ, City Clerk 17 (SEAL) 18 19 20 21 22 23 24 25 26 27 28 1 RESOLUTION NO. 90"199 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS FOR 3 CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT 4 AN ELECTION TO BE HELD ON TUESDAY, NOVEMBER 6, 1990. 5 WHEREAS, Section 10012 of the Elections Code of the State of California 6 provides that the governing body of any local agency adopt regulations 7 pertaining to materials prepared by any candidate for a municipal election, 8 including costs of the candidates statements; 9 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DOES 10 HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: 11 SECTION 1. GENERAL PROVISIONS. That pursuant to Section 10012 of the 12 Elections Code of the State of California, each candidate for elective office 13 to be voted for at an election to be held in the City of Carlsbad on November 14 6, 1990, may prepare a candidate's statement on an appropriate form provided by 15 the City Clerk. The statement may include the name, age and occupation of the 16 candidate and a brief description of no more than two hundred (200) words of the 17 candidate's education and qualifications expressed by the candidate. The 18 statement shall not include any party affiliation of the candidate, nor 19 membership or activity in partisan political organizations. The statement shall 20 be filed in the Office of the City Clerk at the time the candidate's nomination 21 papers are filed. The statement may be withdrawn, but not changed, during the 22 period for filing nomination papers and until 5:00 P.M. of the next working day 23 after the close of the nomination period. 24 SECTION 2. SPANISH LANGUAGE. The City Clerk shall have translated only25 the candidate's statements of those candidates requesting same. 26 SECTION 3. ADDITIONAL MATERIALS. No candidate will be permitted to 27 include additional materials in the sample ballot package. 28 1 SECTION 4. PAYMENT. Each candidate filing a candidate's statement shall 2 be billed for the services rendered a sum not greater than his or her actual 3 prorata share of costs for printing, handling, and mailing the candidate's 4 statements, and such bill shall be due and payable immediately upon receipt 5 thereof. 6 SECTION 5. Each candidate shall pay a $25.00 fee at the time the 7 nomination papers are filed with the City Clerk. In lieu of the $25.00 filing 8 fee, candidates may process a petition-in-lieu by acquiring four signatures for 9 each $1.00 of the filing fee. A total of 100 signatures of registered voters 10 in the City shall replace the $25.00 filing fee. Petitions-in-lieu must be 11 submitted to the City Clerk's Office no later than July 26, 1990. 12 SECTION 6. That the City Clerk shall provide each candidate or the 13 candidate's representative, a copy of this resolution at the time nominating 14 petitions are issued. 15 SECTION 7. That this resolution shall apply only to the election to be 16 held on November 6, 1990, and shall then be repealed.
