ITEM EXPLANATION
Section 36516 of the California Government Code provides that
a general law city with a population over 50,000 up to 75,000
may compensate each member of the City Council in the amount of $500 per month. The new salary prescribed by law for a city our size went into effect after the March 1987 special
election. State law also provides for a 5 percent per year increase for each calendar year. The increase for 1987 and
1988 went into effect after the November 1988 election. If
the Council wishes to make the adjustment as allowed by state
law for 1989 and 1990, your action is to introduce Ordinance
No. fl-/da . The increase would not be effective until the new Council is seated after the November 1990 general municipal election.

ORDINANCE NO. NS-122
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2, CHAPTER
2.04 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 2.04.010 TO IMPLEMENT THE STATE LAW AUTHORIZED INCREASE IN COMPENSATION FOR
THE MAYOR AND MEMBERS OF THE CITY COUNCIL.
The City Council of the City of Carlsbad , California,
does ordain as follows:
SECTION I: That Title 2, Chapter 2.04 of the Carlsbad
Municipal Code is amended by the amendment of Section 2.04.010
to read as follows:
112.04.010 Compensation. Each member of the City Council shall receive as salary the sum of $500 per month as authorized by Section 36516 of the Government Code for cities over 50 , 000 and up to and including 75,000 in population plus the sum of $107 per month, representing an increase of 5% per year for each calendar year from the operative date of the last adjustment of salary, for- a total of $607 per month payable at the same time and in the same manner as salaries are paid to other officers and employees of the City. The salaries established by this section are exclusive of any amounts payable to each member of the City Council as
the performance of official duties for the City. This section shall become operative only on and after the
date upon which one or more members of the City Council become
eligible pursuant to Section 36516.5 of the Government Code
for a salary increase by virtue of beginning a new term of
office following adoption of this section.'I

days after its adoption, and the City Clerk shall certify to
the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after
