Approve Resolution No.,%-LfA adopting annual benefit assessments for a benefit area. TEM EXPLANATION: At the Jw.e 26,1990, meeting, Council approved Resolutions No. 90-204,90-205, and 90-206 which directed the Utilities & Maintenance Director to submit an Engineefs Report; approved the Engineefs Report and set a public hearing. The purpose of the hearing is to accept public comment and consider approval of staff's recommendations to levy assessments to fund sn:et lighting and landscape services in FY90-91. The City's Street Lighting District was formed in 1983 according to provisions of the Streets and Highways Code known as the Landscaping and Lighting Act of 1972. The costs of maintaining the City's street lights are funded from assessments to each property owner based on benefit. Last year, Council approved the addition of two landscaping zones to the original district; a median maintenance zone and a tree trimming maintenance zone. The additional zones are being phased into the total assessment financing over a three year period. Fiscal year 1990-91 is the second year of the phase in program with the General Fund contributing one third (1/3) of the maintenance cost for each landscaping zone and thc remaining two thirds (21'3) is being spread through assessments. The approve.! Engineer's Report contains a complete description and cost analysis of the street lighting and landscaping services to be performed. fie Street iighting and Landscaping Maintenance District total budget is $1,544,205.00. The budget consists of the programs: 1) Street Light Maintenance; 2) Street Tree Maintenance; and 3) Median Landscape Maintenance. fie street lighting program budget is $761,826.00. The projected fund balance at the end of FY 89-90 was approximately $300,00.00. It was recommended in the Engineer's Report that this fund balance be reduced by $135,000.00 and apportioned to FY 90-91 expenditures. The fund balance includes energy deposits for new developments and provides for four (4) months of operations. The total assessment spread this year is $52,344.00 more than last year ($569,926.00 vs. $517,582.00) due to an increased number of City maintained street lights and a projected six percent (6%) SDG&E increase. The average increase per benefit assessment parcel is 6.3%. The street tree program budget is $609,404.00. A total of $348,803.00 will be spread through assessments. The benefit cost to an average residential unit will be $26.67, or $14.86 higher than fiscal year 89-90. The median maintenance program budget is $172,957.00. A total of $115,300.00 will be spread thorough assessments. Benefit cost to an average residential parcel will be $2.78 or $1.52 higher than fiscal year 89-90. (See the approved Engineer's Report for budget breakdowns and method of spread formulas.) .. Thus, of the total budget of $1,544,205.00; $1,034,029.00 will be spread through 90- 91 assessments; $232,059.00 will be funded by the General Fund; and $135,000.00 will be funded by the District fund balance. An average single family residence that receives all three services (street lighting, street tree maintenance, and median landscape maintenance) will receive an cissessment of $63.47 for FY 90-91, this is $18.41 more than FY 89-90. 1. ENGINEERS REPORT AGENCY: 'WOF CARtSBAD PROJECR STREET LIGHTING AND IAND!XAPING DISI'RICZ NO. 1 ENGINEERS REPORT PURSUANT TO "DSWING AND LIGHITNG ACX' OF 1972" WHEREAS, this City Comd has previously formed STRJXT UGHTLNG AND LANDSGAPING DISEUm NO. 1 (hmhfter referred to as the 'District') and has levied asse~~ments within the District for prior fiscal years, all p'arsuant to the 'zandscaping and fighting Act of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California, commencing with Section 22500 (hereinrif;es refemd to as the "Act"); and WHEREAS, this City CounciI has previously adopted a Resolution ordering the preparation and filing of an Engineeis "Report", all in accordance with the provisions of the Act. WHEREAS, at this time there has been filed as a part of the "Report", certain plans and specifications for the maintenance of the improvments, an estimate of the costs of maintenance, a diagram of the Districr, and an assessment roll conraining a spread of the estimated costs of maintenance within the District, all as required by the Act and as previously ordered by this city coundl. NOW, THEREFORE, pursuant to the direction from this City Council, this %eport'' is hereby submitted to this City Council pursuant to the provisions of the Act. This "Report" is applicable for the Fical vear commencing July 1, 1990 to June 30, 1991 (hereinafter referred to as the "Fiscal Yea?). This report is prepared in 2 pares (Street Lighting and Iandscaping), each of which consists of the following 3 sub-parts: par^ r. The plans and specifications show and desaibe the general nature, location and extent of the existing and proposed improvements to be maintained and/or serviced during the Fiscal Year. The pIans and specifications also indicate the class and type of impmments to be maintained and/or serviced for each zone within the District. Part II. A DIAGRAM of the Dismct. The Diagram shows the kerior boundaries of the District, the boundaries of any zones within the Dist~ict, and the lines and dimensions of each lot or parcel within the Disaict. Each parcd is identified by a distinctive number or letter. The lines and dimensions of each lot conform to those shown on the County Assessor's map for Fiscal Year. Partm, AN ESTtMAE.
